المستخلص: هدفت هذه الدراسة لمعرفة حكم التخابر في الشريعة الإسلامية، وكيف نظمها القانون الفلسطيني، وقد استخدم الباحث المنهج الوصفي التحليلي في، وقد خلصت هذه الدراسة لمجموعة من النتائج كان أهمها: للتخابر أحكام في الشريعة الإسلامية، فمنها ما هو مباح ومنها ما هو محرم، والعلة في الحل والحرام إنما يكون بناء على الحفاظ على مصالح الإنسان المعتبرة، كما نظم القانون الفلسطيني جريمة التخابر في قانون العقوبات الثوري لمنظمة التحرير الفلسطينية لسنة 1979، وقد فرض عقوبات صارمة على من يرتكب أي من الجرائم التي تندرج تحت التخابر والتجسس، وقد خرجت الدراسة بجملة من التوصيات كان أبرزها: الارتكاز على الشريعة الإسلامية في صياغة وإصدار القوانين عموما، وفي قوانين مكافحة التخابر على وجه الخصوص، وتحديث المواد القانونية الفلسطينية الموضوعية والاجرائية المتعلقة بجريمة التخابر، والتشديد في العقوبات الموقعة على مرتكبي جرائم التخابر؛ لتحقيق الرد العام والردع الخاص.

This study aimed to learn the provisions of the Islamic Shariah regarding Intelligence and espionage work and how it was regulated by the Palestinian law, and the researcher used the descriptive analytical method in this study. The study concluded with several results, the most important of which were: the Islamic Shariah has provisions regarding intelligence and espionage work; and it’s either Halal (allowed) or Haram (sinful and prohibited). The reason behind both the allowance and prohibition is related to the preservation of the interests of all human beings. The Palestinian law also regulated the crime of intelligence and espionage work in the 1979 Revolutionary Code of the Palestine Liberation Organization (PLO). In addition, it imposed severe penalties on those who commit any of the offenses that fall under intelligence and espionage work. Finally, the study concluded with a number of recommendations, the most prominent of which were: the importance of building on the Islamic Shariah in the drafting of laws and the law-making process in general and in the drafting of anti-espionage laws in particular. The study also recommended that the substantive and procedural Palestinian laws relating to the crime of espionage should be kept up-to-date, and that the penalties imposed on the perpetrators of that crimes should be tightened; which as a result should establish both general and specific deterrents and prevent those crimes from happening.
