المستخلص: The importance of this research becomes evident due to it dealing with an important juristic issue, namely criticism in the principles of Islamic jurisprudence, and the field of study is very delicate, namely, the reasoning outside the context. The importance of this subject is further enhanced by the critical character chosen in this research as a prominent scholar and specialist in the principles of Islamic jurisprudence, and he is the great scholar Allama Muhammad bin Ali al-Shawkani and the book under study is Kitabu Irshad al-Fuhul ila tahqiq al-Haq min Ilm al-Usul, one of the important juristic books on the research of the principles of Islamic jurisprudence. The researcher has tried through this distinctive study to contribute to highlight the method of juristic criticism as adopted by Shawkani in his critical comments on the reasoning of some specialists of the principles of Islamic jurisprudence in support of their statements about islamic queries and rules of the principles of jurisprudence, and in his showing criticism which turned out to be built by him according to a clear scientific and strong methodology with rational explanation and description of the reasons stating that those reasonings and argumentations are not valid because they are outside the context and point of dispute and hence they do not refer to the disputed issue. The study included: introduction, prelude, ten chapters, conclusion and indexes. The most prominent results were: To highlight the distinction of the method of the criticism of the principles of Islamic jurisprudence as adopted by Allama al-Shawkani. He is distinguished in the criticism of definitions and the criticism of objections against them and in the criticism of ascribing the statements and preferring one statement to others. Allama al-Shawkani is also distinguished in his methodology in which he has criticized the reasonings and argumentations terming them to be out of the context and point of dispute. In this study, which included twenty-eight examples Allama al-Shawkani has criticized the reasonings and argumentations given by some specialists of the principles of Islamic jurisprudence and he has termed them as out of the context and the point of dispute and invalidated the evidences. It shows the scholarly depth and accuracy in the juristic investigation and excellence in criticism which Allah Almighty has given to him. Among the recommendations of the study were: careful attention to the studies that highlight the efforts of Islamic scholars in criticizing the juristic lessons in general and benefiting from them in the development of skills and the expertise in the principles of Islamic jurisprudence possessed by researchers. It has also recommended, in particular, the study to complete the study of the method of the criticism of the principles of Islamic jurisprudence as adopted by Shawkani in the rest of the topics on which the juristic rules are based and particularly in the disputes that happened between the scholars of the principles of Islamic jurisprudence.

تبرز أهمية هذا البحث من جهة أنه يتناول موضوعاً أصولياً مهماً؛ وهو النقد في مباحث أصول الفقه، ومحل الدراسة في جانب دقيق وهو الاستدلال خارج محل النزاع، وتزداد أهمية هذا الموضوع من جهة الشخصية الناقدة المختارة في هذا البحث؛ وهو عالم أصولي محقّق مميّز، هو العلامة محمد بن علي الشوكاني، والكتاب موضع الدراسة هو كتاب إرشاد الفحول إلى تحقيق الحق من علم الأصول وهو من الكتب الأصولية المميزة في التحقيق الأصولي. وقد حاول الباحث من خلال هذه الدراسة الموجزة الإسهام بإبراز منهج النقد الأصولي عند العلّامة الشوكاني في تعقبّاته التي تعقّب بها بعض الأصوليين في استدلالهم المؤيد لأقوالهم في المسائل والقواعد الأصولية، وإظهار نقده الذي اتضح أنه بناه وفق منهج علمي واضح ورصين، مع التعليل وبيان الأسباب بأن تلك الاستدلالات لا يصح الاستدلال بها لأنها خارج محل النزاع، إذ لم تأتِ على المحل المختلف فيه. وقد تضمّنت الدراسة: مقدمة وتمهيداً وعشرة مباحث وخاتمة وفهارس، وكان من أبرز نتائجها: إبراز تميز منهج النقد الأصولي عند العلّامة الشوكاني فكما أنه قد تميّز في نقد التعريفات، ونقد الاعتراضات عليها، ونقد نسبة الأقوال ونقد الترجيح، فقد تميّز العلامة الشوكاني في منهجه الذي سار عليه في نقده للاستدلال خارج محل النزاع، وبحسب هذه الدراسة التي تضمنت ثمانية وعشرين نموذجاً نقد فيها العلامة الشوكاني استدلالات أوردها بعض الأصوليين بأنها خارج محل النزاع، وأبطل الاستدلال ؛ فإنه يتبيّن العمق العلمي والدقة في التحقيق الأصولي والتميّز في النقد الذي وفّق الله له هذا العالم العلّامة. وكان من توصيات الدراسة: العناية بالدراسات التي تعنى بإبراز جهود العلماء في نقد الدرس الأصولي عموماً، والإفادة من ذلك في تنمية المهارات والملكة الأصولية لدى الباحثين، كما أوصت الدراسة على وجه الخصوص بإكمال دراسة منهج النقد الأصولي عند الشوكاني في بقية العناصر التي تبنى عليها القواعد الأصولية، خاصة ما وقع فيه الخلاف بين علماء الأصول.
