المستخلص: In the month of raǧab of the year 621/July 1224, in the presence of two witnesses, the pubescent girl Sayyidat al-Kull, under the tutelage of his father, agrees to take ‘Imran Ibn Musa as husband. The newlyweds, descendants of the Berber tribe Zuwawa, are part of the great families, as this document reveals and especially the large sum given as dowry. It also gives prominence to the recommendations ensuring to the wife a favorable treatment, but her agreement is totally absent from the document. This homogamous marriage, which seems to be arranged between the parents of the newlyweds, partly reflects the nature and type of exchange within a tribal society, which aspires to keep its wealth among its members. We will try thereby to answer some questions, especially to know to what level the rights of this minor girl were respected through this legal document.

Au mois de raǧab de l’an 621/juillet 1224, en présence de deux témoins, la toute jeune fille pubère Sayyidat al-Kull, sous la tutelle de son père, accepta de prendre ‘‘Imrān Ibn Mūsā comme mari. Les époux descendants de la tribu berbère Zuwâwa, font partie des grandes familles comme nous le révèle ce document et notamment la somme importante donnée en tant que dot. Il accorde également une place importante aux recommandations assurant à l’épouse un traitement favorable mais son accord est totalement absent du document. Ce mariage homogame, qui semble être arrangé entre les parents des époux, reflète en partie la nature et le type d’échange au sein d’une société tribale et qui aspire à conserver ses richesses parmi ses membres. Nous tenterons ainsi de répondre à certaines questions, en particulier à celle de savoir jusqu’à quel niveau les droits de cette jeune fille mineure furent-ils respectés à travers ce document légal?
