المستخلص: تهدف هذه الدراسة إلى بيان حقوق المقاتل في الحرب وهي دراسة مقارنة بين الشريعة الإسلامية والقانون الدولي والجهود الدولية في تعزيز وبيان حقوق المقاتل، حيث تهدف هذه الدراسة إلى بيان حقوق المقاتل أثناء الحرب من عدم جواز التمثيل به والكف عن قتال من ألقى سلاحه، والحث على السلم وعقد الصلح مع العدو إذا طلب ذلك وعدم الغدر به بعد الصلح، وهذه الدراسة كذلك تهدف إلى بيان حقوق المقاتل بعد الحرب والتي هي من نتائج الحرب وذلك بالإحسان إلى المقاتل إذا وقع في الأسر بالإضافة إلى عدم الاعتداء عليه إذا جُرح، والحث على دفنه بعد موته إذا لم يوجد من يدفنه. هذه الدراسة تنقسم إلى مقدمة وأربعة مباحث وخاتمة، المقدمة تتحدث عن التعريف بالموضوع وأهميته وسبب اختياره، والمبحث الأول يتحدث عن تعريف المقاتل لغة واصطلاحاً، وتعريف الحرب في الشريعة الإسلامية والقانون الدولي، أما المبحث الثاني فيناقش حقوق المقاتل أثناء الحرب، والمبحث الثالث يناقش حقوق المقاتل بعد الحرب، والمبحث الرابع يتحدث عن الجهود الدولية في تعزيز الحفاظ على حقوق المقاتل، وأخيراً خاتمة البحث تحتوي على أهم النتائج المستخلصة من البحث وكذلك التوصيات.

This study aims to clarify the rights of the combatant at the time of war, it is a comparative study between Islamic law, international law and international efforts to enhance and clarify the rights of the combatant, as this study aims to clarify the rights of the combatant during a war with regard to the inadmissibility of combatant mutilation, harassing or maltreatment and ceasing to fight those who lay down their arms, and urging peace with the enemy if he asks for that, and not betraying him after reconciliation. This study also aims to clarify the rights of the combatant after the war, which are among the results of the war, by offering kindness to the combatant if he is captured, in addition to not attacking him if he is wounded, and urging to bury him after his death if there is no one to bury him. This study is divided into an introduction, four topics and a conclusion, the introduction talks about the definition of the topic, its importance and the reason for choosing it, and the first topic talks about defining a combatant in language and idiomatically, and the definition of war in Islamic and international law, while the second topic discusses the rights of a combatant in the midst of war, the third topic discusses the rights of the combatant after the end of the war, and the fourth topic talks about international efforts to promote the preservation of combatant rights. Finally, the conclusion of the research contains the most important findings drawn from the research as well as recommendations.
