المستخلص: يكاد تاريخ الجزائر كله مؤرخا بالمصادر الفرنسية وهذا ما دفع بعض المؤرخين إلى محاولة إعادة كتابة تاريخ الجزائر اعتمادا على الوثائق المحلية الجزائرية من خلال استكشافها واستعمالها في الدراسات التاريخية، وهذه المسالة ليست جديدة على الباحثين؛ حيث يشتكون دائما من قلتها حينما يشرعون للكتابة عن تاريخ الجزائر، وبتالي من الواجب علينا نحن اليوم كباحثين جدد أن نجتهد لاكتشاف تلك الوثائق المحلية واستعمالها بدل التوقف عند المصادر الفرنسية الجاهزة والسهلة الاستعمال نسبيا حتى لا نقع في عملية تكرار ما كتبه الباحثين السابقين، وإذا كان هذا هو السبب الذي دفعني هنا لاتخاذ هذا الاتجاه في دراستي هذه فإن ما تحتوه من معلومات قد تكون قليلة في نظر القراء ولكنها ستلفت انتباه الباحثين إلى أهمية الوثائق الأرشيفية المحلية التي في اعتقادي أن فيها كل الفائدة لخدمة تاريخنا، وليس هدفي من هذه الدراسة إلا الرغبة في أنقاض بعض الوثائق المحلية من الضياع والتلف وخارجها من رفوفها المظلمة إلى عالم النور بنشرها في الأبحاث العلمية.

Every region of our country Algeria has figures who immortalized their names through their scientific, religious, cultural and even revolutionary activities, and the region of Setif in general has many figures who have had a prominent impact in the dissemination of science.Among those figures Cheikh Alwarthilani ,Cheikh Alarbi Tabani ,Cheikh Mohamed SAdik HAmadouche and Cheikh Saad Tabani, the latter we will talk about in these pages; He is one of the figures of South Setif, the scholar Saad bin Hudna al-Tabbani, the son of the Awlad Tiban region and one of its most prominent great figures. He worked on establishing many angles beginning in his area, Awlad Tiban, and others in the rest of the country and even outside it (Tunisia, Libya..), and his angles were the destination of students from inside and outside the region, attributed to him the Saadia way, Also, with the advent of the French occupation, he led a popular resistance that stood against the advance of the French army in the interior regions, and one of the results of this resistance was his exile and his departure from Algeria towards Tunisia, where he settled. This study attempts to track the status of the Muslim Law courts in Algeria through two types of documents, one of which is local, which is the “Mahakim Sharia” documents, and the other issued by the colonial authority, which is judicial legislation what is the value of the scientific article provided by these documents? And to what extent did the contracts of judges reveal the extent of the change that affected Islamic courts and the rights of judges ? This study aims to introduce these documents and the difficulties that the researcher faces in dealing with them, as well as identifying their characteristics and importance in historical writing on the subject of the judiciary and its relationship to the components of the Algerian society during the occupation period.
