المستخلص: عنوان البحث: من أهم أسس صناعة الفتوى في المعاملات المالية المعاصرة وآثار تخلفها "دراسة تأصيلية". أهيمته: يتناول البحث مسألة مهمة من مسائل الشريعة، وهي الفتوى، وتخصصاً دقيقا للغاية هو المالية المعاصرة، أهم الأسس التي يجب أن يراعيها المفتي الناظر للمعاملة المستجدة. ومشكلته: أن المعاملات المالية المعاصرة لها دقتها التي تستدعي وضع أسس صحيحة تُبنى عليها الفتوى بناء سليما وفق شرع الله ومراده. وهدفه: تعرف أهم الأسس في صناعة الفتوى في المعاملات المالية المعاصرة، وليس له حدود مكانية ولا زمانية ومنهجه استقرائي تحليلي. ولطبيعة البحث لم أتوسع في مسائله ولا في مباحثه، وقد جعلته في تمهيد ومبحثين وخاتمة، تشمل التعريفات ثم الفهم الصحيح للحدود والتعريفات في المعاملات المالية المعاصرة، ومعرفة الضوابط الشرعية للمعاملات المالية المعاصرة، وتحقيق فقه الشروط عند الفتوى في المعاملات المالية المعاصرة، والتمييز بين العقود المركبة في المعاملات المالية المعاصرة، ثم بيان آثار التخلف أو ترك العمل بهذه الأسس، ثم الخاتمة والتوصيات.

Research title: One of the most important foundations of fatwa industry in contemporary financial transactions and the effects of its backwardness, "a fundamental study". Its importance: The research deals with an important Sharia issue, which is the fatwa, and a very specific specialty, which is contemporary finance, and deals with the most important foundations that must be taken into account by the mufti examining the new transaction. His problem: that contemporary financial transactions have their accuracy, which requires es-tablishing correct foundations upon which the fatwa can be properly built in accordance with God's law and purpose. Its goal: to identify the most important foundations in making fatwas in contemporary financial transactions. It has no spatial or temporal boundaries, and its approach is inductive and analytical. Due to the nature of the research, I did not expand on its issues or its discussions, and I made it into an introduction, two sections, and a conclusion, which includes definitions, then the correct understanding of the limits and definitions in contemporary financial transactions, knowledge of the legal controls for contemporary financial transactions, achieving the jurisprudence of condi-tions when issuing fatwas in contemporary financial transactions, and distinguishing between com-plex contracts in Contemporary financial transactions, then explaining the effects of failure or abandonment of these principles, then the conclusion and recommendations.
