المستخلص: من مميزات الشريعة الإسلامية وخصائصها أنها رافعة للحرج عن العباد، ومن ذلك أن الله تعالى قد راعى ما يطرأ على المكلف من شك أو وهم في أمر من أمور الدين، أو يحصل عنده اشتباه بين أمرين متماثلين في الظاهر، مختلفين في الحكم، فجعل له مخرجاً، من خلال الأخذ بالاحتياط. ولما كان الاحتياط من المسائل المهمة في الفقه وأصوله، لكونه أصلاً من أصول الشريعة، ولأن الحاجة للعمل بالاحتياط مهم في حياة المكلفين وارتباطه بأمور دينهم جاءت هذه الدراسة لبيان مفهوم الضابط وبيان علاقته بالألفاظ المشابهة، وبيان التكييف الشرعي للاحتياط ومنزلته من الأدلة وبيان ضوابطه ثم الخاتمة وفيها اهم النتائج ومنها: أن للعمل بالاحتياط مدخل عريض في كثير من أبواب الفقه وأحكامه وله ارتباط واسع بكثير من الأصول والقواعد الفقهية، أن للاحتياط ضوابط لابد من مراعاتها ويمكن تقسيمها إلى: ضوابط الأصل الذي يحتاط فيه، وضوابط العمل بالاحتياط، وضوابط الترجيح بالاحتياط.

The Islamic Sharia has advantages and characteristics such as relieving the worshipers from embarrassment, this includes the fact that Allah Almighty considered any doubt or delusion that occurs to the accountable person regarding a matter of religion, or a suspicion arises in his/her mind between two matters that are identical in appearance but different in ruling, so Allah Almighty has made a way out for him/her by taking precaution. Since precaution is one of the important issues in Islamic jurisprudence and principles, as it is one of the principles of Sharia law, and because the need to practice precaution is important in the lives of those accountable persons and its connection with the matters of their religion, this study is conducted to explain the concept of control and explain its relationship to similar words, and explain the definition of Sharia precaution and its position in the evidence and explain its controls. The conclusion that contains the most relevant findings, including The practice of precaution has a wide scope in many chapters of Islamic jurisprudence and its rulings, and it has a broad connection with many jurisprudential principles and rules. Precaution has controls that must be taken into account and can be divided into: the controls of the principle in which one must take precaution, the controls of applying precaution, and the controls of giving preponderance to precaution.
