المستخلص: تناول البحث قضية نسب الفراش الشرعي بين الاحتكام للماء والاحتكام لعقد الزواج، وقد جاء هذا البحث على النحو التالي: التعريف بمفردات البحث، وطرق إثبات النسب المتفق عليها والمختلف فيها، إثبات النسب من خلال عقد الزواج الصحيح، وما في معناه كثبوت النسب بالخلوة الشرعية، وثبوته في العدة، وفي النكاح الفاسد وبالوطء بشبهة، وصور ثبوت النسب بين الاحتكام للماء والاحتكام لعقد الزواج كثبوته في ولد المغتصبة المتزوجة الذي ولد على فراش الزوجية، وثبوت نسب ولد الهاربة من زوجها المولود على فراش الزوجية، وثبوت نسب ولد المتزوجة بأكثر من واحد إذا جاءت به مع قيام الزوجية، وثبوت نسب ولد المتزوجة الملقحة بمني غير الزوج أثناء عملية التلقيح الصناعي، وثبوت نسب ولد المتزوجة مع استحالة ثبوته من الزوج، وخاتمة فيها أهم نتائج التي توصل إليها الباحث.

The research dealt with the issue of the proportions of the legal bed between the recourse to water and the recourse to the marriage contract, and this research came as follows: Definition of research vocabulary, methods of proving the agreed and disputed lineage, proof of parentage through the correct marriage contract, and what is in its meaning the double lineage by legal seclusion, and its proof in the kit, and in corrupt marriage and intercourse with suspicion, and pictures of proving the lineage between resorting to water and resorting to the marriage contract as it is confirmed in the child of the married rapist who was born on the marital bed, and proving the lineage of the child of the fugitive from her husband born on the marital bed, and proving the lineage of the child of a married woman with more than one if she brings it with the establishment of the marriage, And prove the lineage of the child of the married woman who is fertilized with the sperm of other than the husband during the process of artificial insemination, and prove the lineage of the child of the married woman with the impossibility of proving it from the husband, and the conclusion of the most important results reached by the researcher.
