المستخلص: إن مسؤولية إسرائيل عن ضمان وفاء دولة فلسطين بالتزاماتها الدولية تشكل جانبا حاسما من العلاقات الدولية تواجه دولة فلسطين تحديات في تنفيذ الاتفاقيات والمعاهدات الدولية بسبب الاحتلال الإسرائيلي، والقيود المفروضة على حركة الأشخاص والبضائع، وعدم تمكين سلطاتها الوطنية. وتشمل التزامات إسرائيل كدولة محتلة احترام حقوق الإنسان، والحد من تأثير احتلالها على السكان المحليين، وضمان حماية المدنيين. وتتحمل إسرائيل المسؤولية الدولية عن الإجراءات والقيود التي تمنع فلسطين من تنفيذ التزاماتها الدولية، وعلى المجتمع الدولي العمل على محاسبة إسرائيل وحثها على الالتزام بالقانون الدولي. الدراسة تهدف إلى فهم الأسس القانونية الدولية للاتفاقيات والمعاهدات الدولية المتعلقة بدولة فلسطين، وتحديد الاتفاقيات والمعاهدات التي وقعتها الدولة وتقييم مدى التزامها بها. كما تهدف الدراسة إلى تحليل العوائق التي تعترض الالتزام بتلك الاتفاقيات والمعاهدات، بالإضافة إلى استكشاف الفوائد المحتملة لعدم الالتزام. وتشمل الدراسة أيضا تحليل المسؤوليات الدولية لضمان التزام دولة فلسطين بالالتزامات الدولية، ودراسة دور القانون الدولي في تنفيذ تلك الاتفاقيات والمعاهدات والتعرف على مسؤوليات إسرائيل لعدم إيفاء دولة فلسطين بالتزاماتها الدولية. اعتمد البحث على المنهج التحليلي الاستقرائي لدراسة مسؤولية إسرائيل عن عدم إيفاء دولة فلسطين بالتزاماتها الدولية من خلال تحليل الأطر القانونية الدولية والمحلية التي تحكم العلاقة بين الطرفين ومراجعة السياسات الإسرائيلية ومدى توافقها مع القانون الدولي، ودراسة حالات محددة لتأثير هذه السياسات على قدرة فلسطين على الوفاء بالتزاماتها الدولية، ووصف الوضع الحالي في الأراضي الفلسطينية المحتلة وتأثير السياسات الإسرائيلية على الحياة اليومية للفلسطينيين، ومقارنة ذلك بحالات مشابهة حول العالم، وتحليل القوانين والمعاهدات الدولية والوطنية وقرارات المحاكم الدولية لتحديد مدى انتهاك السياسات الإسرائيلية للقانون الدولي وتأثيرها على التزامات فلسطين الدولية. تم التوصل إلى النتائج التالية وقعت دولة فلسطين العديد من الاتفاقيات الدولية في مجالات متنوعة كالدبلوماسية وحقوق الإنسان والبيئة والتجارة والتنمية المستدامة، وتستند في تنفيذ هذه الاتفاقيات إلى مبادئ قانونية دولية معترف بها. إلا أنها تواجه تحديات عديدة في الوفاء بالتزاماتها الدولية، خاصة في مجالات حقوق الإنسان والإغاثة الإنسانية، نتيجة للعوائق السياسية والاقتصادية والأمنية الناجمة عن الاحتلال الإسرائيلي. ورغم هذه التحديات، شهدت بعض المجالات مثل الحقوق الاقتصادية والاجتماعية والثقافية تحسنا. تعتبر الاتفاقيات والمعاهدات الدولية جوهر العلاقات الدولية والتعاون بين الدول، حيث تلعب الأمم المتحدة دورا حيويا في تطويرها وتنفيذها وإسرائيل بصفتها دولة احتلال تتحمل مسؤولية ضمان وفاء فلسطين بالتزاماتها الدولية، لكنها تعيق ذلك لمنع فلسطين من تحقيق السيادة الكاملة على أراضيها وشعبها. وتفرض إسرائيل قيودا على حركة الأشخاص والبضائع والموارد، مما يؤثر سلبا على الاقتصاد الفلسطيني ويعيق التنفيذ الفعال للاتفاقيات الدولية. يجب على إسرائيل احترام حقوق الإنسان في الأراضي المحتلة وضمان حماية المدنيين وتمييزهم عن الأهداف العسكرية، ومنع أي هجمات على المدنيين وممتلكاتهم. توصي الدراسة بتشجيع فلسطين على تعزيز الالتزام بالاتفاقيات الدولية من خلال تطوير آليات تنفيذ فعالة ومراجعة دورية للتقدم، وتعزيز الحوكمة والشفافية في مؤسساتها. يجب زيادة الجهود لحماية حقوق الإنسان، والمطالبة بالمساءلة عن الجرائم ضد الفلسطينيين. كما توصي بتعزيز الدعم الدولي لفلسطين وتكثيف العمل الدبلوماسي للضغط على إسرائيل لاحترام الاتفاقيات الدولية. ينصح بتعزيز التعاون مع الدول الصديقة، وإنشاء آلية لرصد الانتهاكات الإسرائيلية، وتعزيز الإطار القانوني والمؤسسي، ودور المجتمع المدني الفلسطيني في مراقبة وتنفيذ الاتفاقيات الدولية.

The responsibility of Israel to ensure that the State of Palestine fulfills its international obligations is a crucial aspect of international relations. The State of Palestine faces challenges in implementing international agreements and treaties due to the Israeli occupation, restrictions on movement of people and goods, and lack of empowerment of its national authorities. Israel's obligations as an occupying state include respecting human rights, limiting the impact of its occupation on the local population, and ensuring the protection of civilians. Israel bears international responsibility for measures and restrictions that prevent Palestine from implementing its international obligations, and the international community should work to hold Israel accountable and urge it to abide by international law. The study aims to understand the international legal foundations of agreements and treaties related to the State of Palestine, identify the agreements and treaties signed by the state, and evaluate its compliance with them. The study also seeks to analyze the obstacles to adherence to these agreements and treaties, in addition to exploring the potential benefits of non-compliance. The study includes an analysis of international responsibilities to ensure Palestine's compliance with international obligations, as well as examining the role of international law in the implementation of these agreements and treaties. It also identifies Israel's responsibilities to ensure that Palestine fulfills its international commitments. The research adopted the inductive analytical method to study Israel's responsibility for ensuring Palestine's compliance with its international obligations by analyzing the international and local legal frameworks governing the relationship between the two parties, reviewing Israeli policies and their alignment with international law, and studying specific cases of how these policies affect Palestine's ability to meet its international obligations. The study describes the current situation in the occupied Palestinian territories and the impact of Israeli policies on the daily lives of Palestinians, comparing this with similar cases around the world, and analyzing international and national laws and treaties as well as international court decisions to determine the extent of Israeli policy violations of international law and their impact on Palestine's international commitments.

The following results were reached: The State of Palestine has signed numerous international agreements in various fields such as diplomacy, human rights, environment, trade, and sustainable development, and relies on recognized international legal principles to implement these agreements. However, it faces numerous challenges in fulfilling its international obligations, especially in human rights and humanitarian relief, due to political, economic, and security obstacles arising from the Israeli occupation. Despite these challenges, some areas, such as economic, social, and cultural rights, have seen improvements. International agreements and treaties are the cornerstone of international relations and cooperation between countries, with the United Nations playing a vital role in their development and implementation. As an occupying power, Israel bears the responsibility to ensure that Palestine fulfills its international obligations, yet it hinders this by preventing Palestine from achieving full sovereignty over its lands and people. Israel imposes restrictions on the movement of people, goods, and resources, negatively impacting the Palestinian economy and hindering the effective implementation of international agreements. Israel must respect human rights in the occupied territories, ensure the protection of civilians, distinguish them from military targets, and prevent any attacks on civilians and their properties. The study recommends encouraging Palestine to enhance its commitment to international agreements by developing effective implementation mechanisms and periodic progress reviews, and by promoting governance and transparency in its institutions. Efforts to protect human rights should be increased, and accountability for crimes against Palestinians should be demanded. The study also recommends enhancing international support for Palestine and intensifying diplomatic efforts to pressure Israel to respect international agreements. Strengthening cooperation with friendly countries, establishing a mechanism to monitor Israeli violations, and reinforcing the legal and institutional framework and the role of Palestinian civil society in monitoring and implementing international agreements are advised.
