أحدثت الثورة التي شهدها العالم على المستوى الرقمي وتطور مجال تكنولوجيا الاتصال والإعلام، تغييرا جذريا في حياة مختلف الشعوب والمجتمعات. وقلصت معاناة الكثير من الناس في الحصول على المعلومة والخدمة، حيث أن التطور السريع الذي عرفته تقنيات الاتصال والإعلام أدى إلى تحسين عدة قطاعات مختلفة، عن طريق الرفع من جودة الخدمات المقدمة للمواطنين وتبسيط الإجراءات كذلك. الشيء الذي يثبت أن الرقمنة اليوم أضحت تفرض نفسها بقوة في العديد من المجالات، لا على مستوى الاتصال والإعلام أو ما هو صناعي، وكذلك ما له ارتباط بالتجارة والخدمات أو المعاملات بشكل عام. وحيث أن القانون من خصائصه مسايرة التطورات التي يشهدها العالم، وعلى اعتبار أن من بين أهم أدواره مواكبة الظواهر الاجتماعية، وتنظيمها تنظيما يليق بها، فكان عليه لزاما أن يتأثر بهذا التطور الرقمي الذي شهده العالم وأن ينعكس على تشريع مختلف الدول بما فيها المغرب.
The revolution that the world has witnessed at the digital level and the development of the field of communication and media technology have brought about a radical change in the lives of various peoples and societies. It reduced the suffering of many people in obtaining information and service, as the rapid development witnessed by communication and media technologies led to the improvement of several different sectors, by raising the quality of services provided to citizens and simplifying procedures as well. The thing that proves that digitization today has become strongly imposing itself in many fields, not at the level of communication, media, or anything industrial. As well as what is related to trade, services or transactions in general. Since the law has one of its characteristics in keeping pace with the developments taking place in the world, and considering that one of its most important roles is keeping pace with social phenomena and organizing them in a manner befitting them, it was necessary for it to be affected by this digital development that the world has witnessed and to be reflected in the legislation of various countries, including Morocco.
