يهدف هذا البحث إلى بيان مسألة الذكاة الشرعية والتطورات الطارئة عليها، من خلال تتبع نصوص الفقهاء، ولتحقيق هدف هذا البحث فقد سلك الباحث المنهج الاستقرائي التحليلي. وقد اشتمل البحث على: مقدمة، وثلاثة مباحث، وخاتمة، حوى المبحث الأول على التعريف بالذكاة الشرعية، والمبحث الثاني على شروط الذكاة، والمبحث الثالث على الشرعية الطرق الحديثة للذكاة. وقد خلص البحث في نتائجه إلى بيان مقصد الشارع في باب الذكاة الإحسان في التذكية، والابتعاد عن كل ما يزيد من ألم الحيوان، وأن الأصل في الذبح أن يكون بغير صعق أو تدويخ أو غيرها من الطرق الحديثة، كما بين وجوب مراعاة الآداب الإسلامية وأن مراعاتها أولى في التذكية من سرعة التذكية، كما بين جواز استخدامها في حال وجود مصلحة أعلى هذه الطرق بشرط مراعاة الضوابط الفنية التي تضمن عدم موت الحيوان بسبب غير التذكية. في خلال إعداد هذا البحث تبين للباحث بعض التوصيات التي لابد من ذكرها: ١- متابعة الطرق الحديث في ضوء ما يستجد من تقدم علمي، وتقديم الرأي الشرعي فيها. ٢- ضرورة تفعيل دور المقاصد عند إبداء الرأي الشرعي فيما يستجد من نوازل في هذا الباب.د
This research aims to clarify the issue of legal slaughter and the developments resulting from it, by following the texts of jurists. To achieve the goal of this research, the researcher followed the inductive and analytical approach .The research included: an introduction, three sections, and a conclusion. The first chapter included an introduction to the law of zakat, the second chapter on the conditions of zakat, and the third chapter on the ruling on zakat and its modern methods .In its results, the research concluded with an explanation of the law’s purpose in the chapter on slaughtering: to be charitable in slaughtering, and to avoid anything that increases the animal’s pain, and that the basic principle in slaughtering is that it should be done without stunning, stunning, or other modern methods. It also clarified the necessity of observing Islamic etiquette and that observing it is more important. In slaughtering, it is necessary to quickly slaughter it. He also stated that it is permissible to use these methods if there is a higher interest in these methods, provided that the technical controls that ensure that the animal does not die due to reasons other than slaughtering are observed. During the preparation of this research, the researcher discovered some recommendations that must be mentioned: 1- Following up on modern methods in light of new scientific progress, and presenting the legal opinion on them. 2- The necessity of activating the role of objectives when expressing the legal opinion regarding new calamities in this regard.
