المستخلص: إن من أهم أبواب المعاملات المالية المعاصرة، وأكثرها واقعية، وأسرعها تجدداً وتغيراً ما يتعلق بالحسابات الجارية في المصارف؛ لارتباطها بكثير من تعاملات الناس وعقودهم اليومية، ونظراً لما نعيشه من تطور مذهل في وسائل التقنية أثر ذلك بشكل مباشر على القطاع المصرفي بشكل واضح. وفي هذا البحث تناولت جانباً مهماً في الحسابات الجارية، وهو: (الأضرار الناشئة عن الحوالات المصرفية الصادرة عبر الحسابات الجارية، دراسة فقهية مقارنة بالأنظمة المصرفية في المملكة العربية السعودية)، فجمعت أبرز هذه الأضرار، وبينت صورها وأحوالها، وقمت بدراسة الأحكام الفقهية المترتبة على هذه الأضرار، دراسة فقهية مؤصلة مستندة للأدلة الشرعية، مع مقارنة ذلك بما ورد في الأنظمة واللوائح المعتمدة في المملكة العربية السعودية، ومن أبرز هذه الأضرار: الأضرار المالية الناشئة عن التحويل الخاطئ، والأضرار الناشئة عن التحويلات الناتجة عن اختراق الحسابات الجارية، والأضرار الناشئة عن التحويل لحساب صاحبه مطلوب للجهات المختصة، أو ممن يحظر التعامل معه، والأضرار الناشئة عن التحويل لحساب تابع لمهن أو لمنتجات محرمة، الأضرار الناشئة عن تأخر المصرف في تنفيذ الحوالة والحكم المترتب على هذه الأضرار. وذكرت بعد ذلك بعض الحلول والمقترحات التي يمكن بتطبيقها تفادي كثير من هذه الأضرار، وأوردت بعد ذلك بعض التطبيقات القضائية على محل الدراسة. والمجتمع في حاجة إلى معرفة هذه الأضرار المترتبة على الحوالات المصرفية، والعلم بالأحكام الشرعية لها، ومن الذي يتحمل آثار اختراق الحسابات الجارية، ومن فوائد ذلك: أنها تدفع صاحب الحساب إلى الحفاظ على معلومات الحسابات، وبياناته، وعدم إفشائها لأي أحد، والتحوط الشديد والتدقيق البالغ عند إجراء أي حوالة مصرفية عبر الحساب الجاري؛ ليسلم بذلك من الأضرار والمخاطر المحتملة.

One of the most important, most realistic, and fastest-changing sections of contemporary financial transactions relates to current accounts in banks; Because it is linked to many people’s daily transactions and contracts, and because of the amazing development in the means of technology, this directly affected the banking sector clearly. In this research, I addressed an important aspect in current accounts, namely: (The damage caused by bank transfers issued through current accounts, a jurisprudential study compared to banking systems in the Kingdom of Saudi Arabia), collected the most prominent of these damages, showed their images and conditions, and studied the jurisprudence resulting from these damages, a continuous jurisprudential study based on the Sharia evidence. Comparing this with the provisions of the laws and regulations adopted in the Kingdom of Saudi Arabia, the most prominent of these damages are: financial damages arising from the wrong transfer, damages arising from transfers resulting from the violation of current accounts, and damages arising from the transfer of the account of the owner is required to the competent authorities, or those who are prohibited to deal with it. damages arising from the transfer to an account belonging to prohibited professions or products, damages arising from the delay of the bank in carrying out the transfer and the resulting judgment. She then mentioned some solutions and proposals that could be applied to avoid many of those damages, and then set out some judicial applications to the subject. Society needs to know about these damages resulting from bank transfers, and know the legal provisions of them, and who bears the effects of the current account breach, among the benefits of this: it causes the account holder to keep account information, data, not to disclose it to anyone, and to be very careful and careful when making any bank transfer through the current account; Acknowledge the potential damage and risks.
