|a تهدف هذه الدراسة إلى التعرض للالتزام بالإعلام، الذي جاء به نص المادة 1-1112 من القانون المدني الفرنسي، من خلال تحليل نصها وتقييم ما حملته في طياتها، للوقوف على حاجة المشرع لها والإضافة التي جاءت بها في الشريعة العامة، مع تقصي أثرها على العدالة التعاقدية، خاصة في ظل انسحاب هاته الأخيرة على المرحلة السابقة للتعاقد. وقد كرس المشرع الفرنسي الالتزام بالإعلام في الشريعة العامة، لما له من أثر على مرحلة المفاوضات، حيث يعمل على خلق توازن نوعي في العلاقات العقدية، في ظل اتساع الهوة المعرفية بين الأطراف، وتغطية النقص الذي شاب نظرية عيوب الإرادة والتشريعات الخاصة على حد سواء، كما أكد على التزام السرية كضمانة لهذا الالتزام، ويهدف من وراء هذا كله إلى تحقيق أكبر قدر من العدالة التعاقدية.
|b The aim of this study is to examine the obligation to inform laid down in article 1112-1 of the French Civil Code, by analyzing this article and evaluating its provisions, in order to ascertain the legislator's objective and its contribution to common law, while attempting to discover its influence on contractual justice, in particular the extension of its scope to the pre-contractual phase. The legislator required that the obligation to inform be included in common law, because of its impact on the negotiation phase, as it aims to create a qualitative balance in contractual relations, given the growing gap in knowledge between the parties, and to fill the gaps that marred both the theory of defects in consent and special legislation, while emphasizing the duty of confidentiality as a guarantee of this obligation, with a view to establishing the greatest possible of contractual justice.
