The study addresses the issue of administrative judicial oversight over the public accountant in the field of public debt collection by analyzing the legal framework governing his liability and the jurisdiction of administrative courts in disputes arising from the application of the Public Debt Collection Code. It highlights that the authority of the public accountant in collection is not absolute but is restricted by the principle of legality and a set of formal and substantive procedures that constitute fundamental guarantees for the debtor, whether related to preliminary measures such as sending the final notice without fees and obtaining authorization to proceed, or to accompanying conditions such as proper notification and respect for statutory time limits between the various stages of compulsory collection, including warning, seizure, sale, and physical coercion. The study also clarifies the nature of disputes brought before administrative courts, whether substantive disputes concerning collection procedures and the existence of the obligation to pay, or interim disputes related to requests for suspension of execution and suspension of payment and the assessment of submitted guarantees. It further elaborates on the legal foundations of the administrative liability of the public accountant, distinguishing between personal and service-related liability, and explaining the judicial criteria used to differentiate between personal fault and service fault, with reference to Moroccan and French case law regarding the requirement of gross fault or the sufficiency of simple fault depending on the nature of the activity and the difficulties associated with it.
