اخترنا هذا البحث الموسوم (أحكام عزل الوكيل) لأن التعامل به أصبح كثيرا بين الناس، وفي الكثير من التصرفات والأفعال الضرورية، كالبيع والإيجار والحج والنكاح والقضاء وغيرها. ولاسيما أن مهنة المحاماة المهمة والشائعة هي صنف من أصناف الوكالة، ولما لها من أهمية في رفع الظلم وإظهار الحق، والنيابة عن الموكل في استرجاع حقه بواسطة المرافعات القضائية في المحاكم. ويلاحظ أهمية البحث نحو إزالة الغموض عما يجهله البعض عن دور الشريعة الإسلامية، لما لها من أهمية بتنظيم معاملات الناس، وحكم علاقاتهم بعضهم ببعض، خصوصا في بحثنا الخاص بعزل الوكيل عن الوكالة. وقد تضمن هذا البحث أحكام انتهاء الوكالة بالعزل، سواء عزل الموكل وكيله، أم عزل الوكيل نفسه، وفي معظم المذاهب الإسلامية (الامامية، والحنفية، والشافعية، والحنابلة، والمالكية، والزيدية، والظاهرية) وقد تناولنا آراء الفقهاء بحيادية أكاديمية بحتة. وبحثنا انتهاء الوكالة بسبب خروج الموكل أو الوكيل عن أهلية التصرف بالجنون أو الموت أو غير ذلك من الأسباب التي تؤثر في أهلية المتعاقدين، إضافة إلى ما تضمنه القانون المدني من مواد تخص موضوع البحث.
