المستخلص: The new Algerian law opted for a system in which the arbitral award is normally susceptible of appeal, and so, made on a first level. In this respect, the control made by the state court of second level is general and tends to correct the breaches that are imputable to the arbitrators. On the contrary, concerning the breaches that are imputes to the parties, there be a control stricto sensu, aiming at deciding the adequate consequence of the irregularity, including the setting aside of the award. In the field of international arbitration, the special provisions condition too articles (1056 and 1058) relating to the cases in which the enforcement order is retracted or the award set aside. These cases have to be assessed as limitative and exclusive. The judge may not add to them 'non-statutory' grounds. The two unique grounds for annulment related to the proceedings are: the breach to the right of defence and the lack or the contradiction of the reasons for the award. The first one shall include any attempt to the public order principles, notably the equality of the parties and the honesty. The second shall not be hiding a control on the merits. The judge has to restrict himself to the case of manifest contradictory grounds, which make the award manifestly lacking any reason. He is barred from assessing the pertinence or the [exactness] of the reasons for award. The violation of the other procedure rules, including those relating to the stay to rule in case of challenge of arbitrator or criminal objection/incident, are not valid grounds for annulment. Those are the warranties of a minimum control which preserves the flexibility of the conduct of the arbitral procedure.
