المستخلص: Analogical reasoning (al-Qiyas) is considered as one of the most important subjects of the discipline of Foundations of Islamic Jurisprudence (usool al-fiqh). Analogical reasoning will not be completed without the existence of its pillars, the most important of which is reason of legislation (Illah). Manners of reason behind legislation are two, namely prescribed and reason- based manners. Of the most important paths of the latter path is that of probing and dividing (al-sabr wa al- taqsim) which is followed most by researchers, therefore, this research presents the idea of probing and dividing, its types, legitimacy, authority, and the relation between the types of this path and their impact on the authorization of the path in question. This is done with an investigation of the views of the esteemed scholars about this issue. Finally, the research presents the conditions of applying the path of probing and dividing as one of the paths of reason behind legislation. Due to this status and importance of this path we have chosen it as subject of the present research.

إن القياس من أهم أبواب علم الأصول، ولا يتم القياس إلا بأركانه، وأهم هذه الأركان العلة، ومسالك العلة عند أهل القياس نوعان؛ نقلية واجتهادية، ومسلك السبر والتقسيم من أهم المسالك الاجتهادية، وأكثرها استعمالا عاما على السنة الباحثين الشرعيين، فالبحث يبين فكرة السبر والتقسيم، من جهة حجية هذا المسلك، وأقسامه، والعلاقة بين الأقسام والحجية، مبينا أثر هذه الأقسام في القول بالحجية من عدمها، مع تحقيق قول كبار أئمة الأصول، ثم بيان شروط العمل بالسبر والتقسيم كمسلك من مسالك العلة، ولهذه المكانة والأهمية جعلت هذا المسلك محل البحث والدراسة.
