المستخلص: موضوع البحث: مبحث التعارض والترجيح من أهم المباحث الأصولية، وقد عني الأصوليون بدراسة طرق دفع التعارض، والتي من أبرزها الجمع بين الدليلين المتعارضين. والجمع بين النصوص المتعارضة أنواع ومسالك، منها الجمع باختلاف الحال، وهو مسلك قوي؛ لكنه لم يخص بمزيد دراسة؛ بل يدرج ضمن الكلام على المخلص من التعارض، أو طرق دفع التعارض وتحديدا الجمع؛ ولعل السبب في ذلك أن من أنواع الجمع الأخرى انفردت بمباحث في مظانها كالجمع بالتخصيص أو التقييد إلخ. والجمع باختلاف الحال قد يتداخل مع أنواع أخرى للجمع، كالجمع باختلاف المحل أو الحكم، فهل بينهما فرق؟ وإذا فهل هو مؤثر؟ ومن أهمية الجمع باختلاف الحال أن تطبيقاته الفقهية كثيرة، ومنثورة في كتب العلماء. ويظهر لنا من خلال التطبيقات الفقهية مسألتان: الأولى هي تعدد أنواع الجمع في المسألة الواحدة، فهل هو تعدد عضد أم تعارض؟ وأما الثانية فهي تعدد طرق دفع التعارض في المسألة الواحدة، وأحيانا من أصحاب المذهب نفسه، فما الأثر المترتب على ذلك؟ أما تعدد أنواع الجمع في المثال الواحد فهو على الأغلب تعدد عضد وغير مؤثر في تكييف النتيجة الفقهية، وكذلك تعدد مسالك الترجيح في المسألة الواحدة، أما تعدد مسالك دفع التعارض فهو بلا شك تعارض وتستوجب الترجيح بينها، ويترتب عليها اختلاف في الثمرة الفقهية.

Research Address: Combination by Different Condition -An Applied Fundamentalist Study Research Subject: The study of contradiction and probability is one of the most important fundamentalist studies, and a delegation that fundamentalists have been interested in studying it and knowing ways to push the opposition, the most prominent of which is the combination of the two opposing evidence; Because realizing evidence is more important than neglecting it. The combination of contradictory texts has types and paths, including combination in different conditions, which is a strong conduct. It was not singled out for further study. Rather, it is included in the speech on the conclusion of the contradiction or the methods of opposing the conflict, specifically the combination. Perhaps the reason for this is that among the other types of pluralism, it is unique in matters of investigation, such as combination by assignment or restriction, etc. Combination in different conditions may overlap with other types of pluralism, such as plural according to place or ruling, so is there a difference between them? If there is a difference, is it effective? One of the importance of combining differently is that its jurisprudential applications are many, and it is published in the books of scholars and their commentaries. Through the jurisprudential applications, two issues appear to us. The first is the multiplicity of types and paths of pluralism in one issue. Is it multiple humeral or opposed? As for the second, it is the multiplicity of methods of defending the contradiction in one issue, and sometimes from the owners of the same doctrine, so what is the effect of that?
