المستخلص: يهدف هذا البحث إلى دراسة سريان أحكام القضاء الدستوري بعدم دستورية القانون من حيث الزمان، وخاصة بيان القاعدة الدستورية أو القانونية العامة التي تتعلق بالأثر أو النطاق الزمني لهذه الأحكام القضائية، من حيث كونها تسري بأثر فوري أي مباشر من تاريخ صدور الحكم القضائي أو نشره، أو تسري بأثر رجعي من تاريخ صدور القانون.
ويكتسي هذا البحث أهمية متزايدة بالنظر لكونه يربط الأثر الزمني للحكم الصادر بعدم الدستورية بمبدأ المشروعية ومبدأ الأمن القانوني، وهو ما يثير العديد من الإشكاليات القانونية الجديدة، فالنظم القانونية التي تأخذ بقاعدة الأثر الرجعي تعطي الأولوية لمبدأ المشروعية على حساب مبدأ الأمن القانوني، أما النظم التي تأخذ بقاعدة الأثر الفوري أو المباشر فينظر إليها بعض الفقهاء بأنها تحقق قدراً من التوازن بين مبدأ المشروعية ومبدأ الأمن القانوني، ومع ذلك يمكن النظر إلى هذه النظم الأخيرة أيضاً بأنها تحدث آثاراً سلبية على تطبيق مبدأ المشروعية، طالما أن الأثر المباشر للحكم الصادر بعدم الدستورية يجعل القانون المخالف للدستور باطلاً منذ لحظة صدور الحكم وصحيحاً قبل صدور الحكم مما يخرق مبدأ المساواة أمام القانون.
وقد عرض البحث الموضوعات الرئيسية لسريان أحكام القضاء الدستوري من حيث الزمان، من خلال مبحثين تناولت فيهما مفهوم قاعدة الأثر الرجعي وقاعدة الأثر الفوري، والأساس القانوني الذي تستندان عليه، والاستثناءات الواردة عليهما، وذلك باعتماد منهج تحليلي نقدي مقارن، يبين الجوانب الإيجابية والسلبية لهذه القواعد العامة.
وقد انتهى البحث إلى تفضيل قاعدة الأثر الفوري أو المباشر على قاعدة الأثر الرجعي للحكم الصادر بعدم الدستورية، طالما يمكن النظر إليها بأنها تحقق قدراً من التوازن بين مبدأ المشروعية ومبدأ الأمن القانوني، حيث تطبق مبدأ المشروعية بالنسبة للحاضر والمستقبل، فضلاً عن أنها تطبق مبدأ الأمن القانوني بالنسبة للماضي. كما أوصى البحث أن ينص الدستور على قاعدة الأثر الفوري مع منح القاضي الدستوري صلاحية تقرير الاستثناءات عليها، كلما تقتضي الضرورة ذلك.


The purpose of this research is to examine the applicability of constitutional court rulings with the unconstitutionality of the law in terms of time. The study will particularly explain the general constitutional or legal rule relating to the effect or temporal scope of these judgments, as they apply with immediate effect, i.e., directly from the date of the promulgation or publication of the judicial judgment or with retroactive effect from the date of promulgation of the law.
This research is increasingly important as it links the temporal effect of a judgment issued with unconstitutionality with the principle of legality and legal security, which raises many new legal problems. Legal systems that adopt the retroactive rule give priority to the principle of legality over the principle of legal security. However, systems that adopt the immediate or direct effect rule are perceived by some jurists as striking a measure of the balance between the principle of legality and the principle of legal security. However, the latter systems can also be seen as having negative effects on the application of the principle of legality as long as the direct effect of the unconstitutionality ruling makes the law contrary to the constitution invalid from the moment the judgment is passed and valid before the judgment is passed, which violates the principle of equality before the law.
The research presented the main topics of the validity of constitutional judgments in terms of time through two research papers dealing with the concept of the retroactive effect rule and the immediate effect rule, the legal basis on which they are based, and the exceptions contained therein, by adopting a comparative, critical analytical approach, which shows the positive and negative aspects of these general rules.
The examination concluded that the immediate or direct effect rule was preferred over the retroactive effect rule of unconstitutionality, as long as it could be viewed as striking a measure of the balance between the principle of legality and the principle of legal security. It applies the principle of legality for the present and future, as well as the principle of legal security in relation to the past. The research also recommended that the constitution must provide for the immediate effect rule and allow the constitutional judge the power to make exceptions to it whenever necessary.
