المستخلص: إنَّ من أعظم نِعَم الله عز وجل على عباده أَنْ شَرَعَ لهم شريعةً تتميز بالشمول والكمال، والعموم والدوام، فوسعتْ جميع الأعصار والأمصار، والحوادث والمستجدات، وملأت الأرض حكمةً وعدلًا، ورحمةً وتيسيرًا في تنظيم مصالح العباد في أمور المعاش والمعاد؛ وإنَّ من المجالات التي تجلَّتْ فيها محاسن شريعتنا الغرَّاء: عنايتها الكبيرة بحفظ النفس الإنسانية من خلال تشريع مبادئ صحية عديدة، وخصوصا عند انتشار الأوبئة والطواعين، كقاعدة الحجر الصحي، والعزل الصحي، وتجنب العدوى، وغير ذلك؛ لأنَّ دفع الحرج والضرر أولى وأيسر من إزالتهما بعد وقوعهما، والاحتراز منهما خيرٌ من التلبس بهما؛ و(الدفع أقوى من الرفع) و(الوقاية خير من العلاج). وقد برزتْ مظاهر هذه المبادئ، وتطبيقات هذه القواعد في الإجراءات الاحترازية والوقائية لحماية النفوس الإنسانية من وباء كورونا، والتي حظيَتْ بإجماع دولي من أهل الشأن والاختصاص، كما أُيَّدت بفتاوى جهات الإفتاء المعروفة في مختلف أقطار العالم؛ وكان من تلك الإجراءات: ما يتعلَّق بصلاة الجماعة في المساجد؛ حيث تمَّ التعرُّض في هذا البحث إلى مشروعية إجراء تعليق الحضور إلى المساجد لصلاة الجماعة أيام انتشار الوباء بالأدلة الشرعية، والمقاصد الشرعية المرعية، والقواعد الأصولية والفقهية؛ لأن تخريج الأحكام على القواعد أولى من إضافتها إلى المناسبات الجزئية، فكل فقه لم يخرج على القواعد فليس بشيء؛ كما تمَّتْ مناقشة شبهات من استنكر هذا الإجراء، وبالغ في ردَّه، مع الكشف عن مكامن الخطأ في موقف هؤلاء، والتي تتلخص في: تغليب العاطفة، وتقصير في تصوُّر النازلة، وتفريط في تحقيق المناط المناسب لها.

One of the greatest blessings of God for his servants is that he legislated for them a law that is characterized by comprehensiveness, perfection, general and permanence, expanding all hurricanes and, accidents and developments, and filling the earth with wisdom and justice, mercy, and ease in organizing the interests of the servants in matters of living and restoration. Among the areas in which the advantages of our Sharia were manifested: its great care to preserve the human soul by enacting many health principles, especially when epidemics and plagues spread throughout the land, such as the rule of quarantine, health isolation, and avoiding infection. Because prevention is much better than the harm, and easier than removing them after their occurrence, and guarding against them is better than wearing them. The manifestations of these principles and the application of these rules have emerged in the precautionary and preventive measures to protect human souls from the Corona epidemic, which have gained an international consensus from the concerned and specialized people, as well as supported by the fatwas of well-known fatwa bodies in various countries of the world. Among those procedures were: what was related to group prayer in mosques, whereas in this research the legality of suspending attendance at mosques for communal prayer during the outbreak of the epidemic was examined with legal evidence, the established Sharia objectives, and fundamentalist and jurisprudential rules. It is more important to bring the rulings to the rules than to add them to the partial occasions, so every jurisprudence has not violated the rules, as if it is nothing. The suspicions of those who denounced this procedure and exaggerated their response were also discussed, with the disclosure of the mistakes in the position of these people, which are summarized in: the overriding emotion, the failure to conceive the calamity, and the negligence in achieving the appropriate areas for it.
