المستخلص: يقتضي نظام اللامركزية الإدارية استقلال المناطق المحلية لصلاحيات واختصاصات خاصة بها تمارس وفقا لما تحدده القواعد الدستورية والتشريعات العادية التي تصدر من السلطة المركزية. وإن ممارسة الهيئات المحلية لصلاحياتها طبقا لتلك الحدود يتطلب قيام الحكومة المركزية بفرض رقابتها على ممارسة تلك الصلاحيات بغية أن تكون تلك الممارسة في الحدود التي رسمها الدستور والقانون. فضلا عن منع التعسف الذي قد يقوم عليه الأشخاص الذين توكل لهم مهمة إدارة شؤون مناطقهم. إن اللامركزية الإدارية تدور وجودا وعدما مع توزيع الوظيفة التنفيذية بين المركز والهيئات المحلية. وعلى الرغم من وجود توزيع للوظيفة التنفيذية فإن هناك إسهاما مشتركا بين الحكومة المركزية والهيئات المحلية وهو إسهام تختلف درجته ومداه باختلاف أحوال وظروف كل دولة ونظامها السياسي. إن ما يميز نطام اللامركزية الإدارية هو استقلال الهيئات الإدارية المحلية وامتلاكها لصلاحيات محددة إلا أن هذا الاستقلال نسبي وليس مطلق. بمعنى أنه قد يضيق أو يتسع وفقا للعلاقة بين السلطة المركزية والمناطق المحلية أي إن اللامركزية الإدارية ليست واحدة فقد تختلف باختلاف ظروف الدولة والتحولات التي تطرأ عليها واختلاف النظام السياسي. ويمكن التعرف على درجات اللامركزية من خلال تطبيقاتها في التشـريعات العراقية المختلفة والتي اختلفت باختلاف الأنظمة السياسية العراقية عبر مراحل متعددة. لذا يقتضي البحث تقسيمه إلى مبحثين نتناول في المطلب الأول الأسس الفلسفية والقانونية لنظام اللامركزية الإدارية. وسنتناول في المبحث الثاني تطبيقات اللامركزية الإدارية في التشريعات العراقية.

As defined b} the Constitution and the law, as well as the prevention of arbitrariness that may be imposed on persons entrusted with the task of managing the affairs of their areas, administrative decentralization revolves around the existence and the distribution of the executive function between the Center and local bodies , Although there is e distribution of the executive function, there is a joint contribution between the central government and local bodies, a contribution of varying degrees and extent to the different conditions and circumstances of each country What distinguishes the system of administrative decentralization is the independence of the local administrative bodies and the ownership of specific powers, but this independence relative, not absolute, I may narrow or expand according to the relationship between the central authority and local areas, ie administrative decentralization is not the same may van their political systems depending on the circumstances and transformations that occur and can identify the degrees of decentralization through their applications in the legislation Iraq's various data which differed according to Iraqi political systems. across multiple stages, so research requires dividing it into two sections we address the first demand philosophical and legal foundations of the system of administrative decentralization, and we will discuss in the second section of administrative decentralization applications in Iraqi legislation.
