المستخلص: من المعلوم أننا في هذه الأيام نعيش تحت وطأة جائحة كورونا كوفيد 19 تلك الجائحة الخطيرة التي اجتاحت شرق العالم وغربه، فأهلكت الآلاف من البشر، وكبدت الاقتصاد العالمي خسائر فادحة، تصعب على الحصر والعد.. ولعل مما ساعد على إنشار تلك الجائحة هو تلك الحالة من العجز والإخفاق في إدارتها، والسيطرة عليها، من قبل الأنظمة الحاكمة في كثير بلدان العالم. في الوقت الذي منحت فيه الشريعة الإسلامية الحكام وولاة الأمر بعض السلطات الاستثنائية أثناء تلك الجوائح، بقصد مساعدهم على مواجهتها ولتصدي لها.. ومن ذلك؛ سلطة تقييد بعض المباحات للضرورة، وللمصلحة العامة، وحماية الأنفس والأموال والثمرات. وقد جاء هذا البحث في محاولة لبيان حقيقة الجوائح، والتنبيه على خطورتها، وضرورة التصدي لها، وبيان أثر تفعيل سلطة الحاكم في تقييد المباحات في تحقيق ونجاح تلك المواجهة، وقد اعتمد الباحث على المنهج الاستقرائي لجمع المادة العلمية من المصادر الموثوقة، والتحليلي لتحليل النصوص عند الاقتضاء، والوصفي لعرض بعض النماذج والتطبيقات العملية، لتقييد المباح أثناء الجوائح، وأثر تفعيله في مواجهتها والتصدي لها. وقد خلصت الدراسة إلى ضرورة تفعيل سلطة الحكام تقييد المباحات لاسيما أثناء انتشار الجوائح، ونتفشى الأمراض والأوبئة، وأن ذلك التفعيل ينبغي أن ينطلق في الأساس من اجتهاد الحاكم في تقدير المصالح والموازنة بينها وبين المفاسد، وأن تنضبط تصرفاته على الرعية بتحقيق المصلحة.

It is known that these days we are living under the weight of the Corona Covid 19 pandemic, that dangerous pandemic that has swept through the east and west of the world, decimating thousands of people, and inflicting heavy losses on the global economy, which are difficult to count and count .. Perhaps what helped spread this pandemic is this case of Impotence and failure to manage and control it by the ruling regimes in many countries of the world. At a time when Islamic law granted rulers and governors some exceptional powers during these pandemics, with the intention of helping them confront them and confront them ... including; The power to restrict some permissible things for necessity, and for the public interest, and to protect souls, money and fruits. This research came in an attempt to clarify the reality of pandemics, to warn about their danger and the need to confront them, and to show the effect of activating the ruler's authority in restricting permissibility in achieving and the success of that confrontation. The researcher relied on the inductive approach to collect scientific material from reliable sources, and analytical to analyze texts when required, and descriptive to present some practical models and applications, to restrict permissibility during pandemics, and the effect of activating it in confronting and addressing pandemics. The study concluded that it is necessary to activate the authority of rulers to restrict permissibility, especially during the spread of pandemics, and the spread of diseases and epidemics, and that this activation should be based primarily on the ruler's diligence in assessing interests and the balance between them and the evils, and that his actions be controlled on the subjects to achieve the interest.
