المستخلص: الحمد لله رب العالمين وصلى الله وسلم على نبينا محمد وآله وصحبه أجمعين، ومن تبعهم بإحسان إلى يوم الدين، أما بعد: فيأتي هذا البحث بعنوان: حقيقة دليل الإجماع ورد شبهات المعاصرين حوله، في مقدمة، وتمهيد، ومبحثين، وخاتمة. ويهدف إلى بيان حقيقة دليل الإجماع عند الأصوليين، ورد شبهات المعاصرين حوله، وقد اتبعت المنهج الاستقرائي التحليلي، بجمع شبه المعاصرين، وتحليلها وترتيبها تحت عناوين الأصوليين ليسهل بيانها والرد عليها، وكان من أهم نتائجه: بيان أن الإجماع دليل شرعي عملي توارثته الأمة، وأن الشبه المثارة حوله لم تفهم كلام الأصوليين على سياقه، وإنما أتت بمعان جديدة بدعوى تفعيل دليل الإجماع. ومن أهم توصياته: تتبع شبهات المعاصرين حول أصول الفقه، خاصة الشبهات التي يترتب عليها انحرافات تؤدي إلى تغيير القواعد الأصولية المتعارف عليها عند الأصوليين. ودراسة جهود الأصوليين في ضبط المصطلحات الأصولية ومعرفة مقاصدهم فيها، فهذا من أعظم أسباب رد الشبهات.

Praise be to Allah, the Lord of the Worlds, and peace be upon our Prophet Muhammad, and his family and companions, and those who followed them with charity until the day of judgement. This research is entitled: The Truth of the Consensus’ Evidence, and the Objection of Contemporaries’ Suspicions about it aims to clarify the truth of the evidence of consensus (ijmā') among the fundamentalists, and responds to the suspicions of contemporaries about it. I followed the inductive and analytical methods, by collecting contemporaries’ suspicions, analyzing and arranging them under the titles of fundamentalists in order to facilitate their clarification and response. In fact, what was raised about the consensus did not understand the words of the fundamentalist scholars in its context, but rather brought new meanings under the pretext of activating the consensus evidence. Among his most important recommendations: Tracking contemporaries ’suspicions about the fundamentals of jurisprudence, especially the suspicions that result in deviations that lead to changing the fundamentalist rules recognized by fundamentalists. Studying the efforts of the fundamentalists in controlling the fundamentalist terminology and knowing their intentions regarding them and this send point is one of the greatest reasons for rejecting suspicions.
