المستخلص: منح القانون جهة الإدارة سلطات واسعة في نطاق تنفيذ العقود الإدارية، ومن هذه السلطات حق الإدارة في الرقابة والتوجيه في أثناء تنفيذ العقد الإداري؛ إذ يمكن للإدارة مراقبة تنفيذ العقد للتحقق من مطابقة الشروط المتفق عليها من الناحية الفنية والمالية، ولها أيضا توجيه المتعاقد في تنفيذ التزاماته التعاقدية. والإدارة حين تمارس هذه السلطة تلتزم الشروط والضوابط المطلوبة، وعليها عدم إساءة استعمال هذه السلطة. وتختلف هذه الرقابة باختلاف العقود الإدارية، ودرجة صلة العقد بالمرفق العام. وتحاول هذه الدراسة توضيح كل هذه المسائل وفقا للاتجاه السائد فقها وقضاء، وصولا إلى تحقيق الهدف الأسمى للإدارة وهو ضمان حسن سير المرافق العامة بانتظام واطراد، وتحقيق المصلحة العامة.

The law gave the public administration wide power in the scope of executing the administrative contracts. One of these authorities or types of power is the right of the administration to control and guide the execution of the administrative contracts. The administration can monitor and oversee the execution of the contract to verify compliance with the agreed terms technically and financially. It also, has the right to guide the contractor in implementing his contractual obligations. When exercising this right, the administration shall abide by the required conditions and rules and not abuse this right or power. This right varies according to administrative contracts, and the degree of relevance of the contract to the public utilities. This study attempts to clarify all these issues according to the prevailing trend of jurisprudence and judiciary, in achieving the ultimate goal of the administration in ensuring the normal functioning of public utilities steadily and achieve the public interest.
