المستخلص: إن المشاكل الزوجية مهما تعاظمت وتنوعت باختلاف الزمان والمكان، لا ينبغي الاستسلام لها وتمكينها من تفتيت وتمزيق نسيج الأسرة، لأن هذا سيولد إرهاقا للزوجين والأولاد معا وضياع الجميع لا سامح الله لأنهم في مركب واحد، سواء كانوا على وعي في هذا الكلام أم لا، فالمسؤولية الأكاديمية والتشريعية والإنسانية تقتضي بيان هذا ، لذلك عملنا على التصدي والوقوف بوجه هذه الخلافات أو المشكلات المعاصرة التي لا طالما عجزت النصوص القانونية النافذة من تقديم حلا مباشرا لها واخص بذكر وهو محل البحث قانون الأحوال الشخصية العراقي رقم ١٨٨ لسنة ١٩٥٩ المعدل، ليس إهمالا من المشرع، وإنما هذه الإشكالات حديثة النشأة ولم تكن موجودة أبان صدور هذا القانون، وهذا لا يمنع من التحرك في تطوير وتطويع النصوص النافذة لهذا القانون من أجل النهوض وتعزيز دور فعال لردم التصدع الحاصل بين الزوجين، بعدما انهكت هذه الأسر المحافظة في مجتمعنا العراقي، فكانت خريطة الطريق المعبدة لهذه الدراسة تسير على نحو فيه موائمة تأصيلية شرعية وقانونية، ثم شخصت مواطن النقص و وضعت الحلول القانونية المناسبة والمعالجة لهذا الإشكاليات بأسلوب وصياغة قانونية محكمة مراعية للظروف ومواكبة للعصر والتطور الحديث، ومانعة لحصول الفرقة بين اطرف العلاقة بناء على رغبة من سعى لإبقاء الزوجية قائمة دون انحلال.
