المستخلص: إن الاستدلال بالكتاب والسنة هو أعلى مراتب الاستدلال، وقد جرت عادة الأصوليين- كما الفقهاء- على الاستدلال بالكتاب والسنة، فاستدلوا لأصول الشريعة قبل فروعها بالكتاب والسنة، فأثبتوا حجية الإجماع والقياس وغيرهما من الأدلة الإجمالية مستندين في ذلك إلى الكتاب والسنة، فالإجماع دليل حجيته في القرآن والسنة، وكذا القياس، وغيرهما مما اختلف فيه، فما اعتبر معتبر دليلا إلا استدل له بشيء من الكتاب أو السنة، ويأتي هذا البحث ضمن الاستدلال بالسنة على المسائل الأصولية، وقد اخترت حديث (أمرت أن ‌أقاتل ‌الناس...) ليكون محلا لهذا البحث بعنوان: الاستدلال بحديث (أمرت أن ‌أقاتل ‌الناس...) على المسائل الأصولية. وتكمن مشكلة هذا البحث في السؤال التالي: ما المسائل الأصولية التي استدل عليها بحديث (أمرت أن أقاتل الناس...)؟ وما وجه الاستدلال بالحديث على تلك المسائل؟ وموضوع هذا البحث هو حديث (أمرت أن أقاتل الناس...) والمسائل الأصولية التي دل عليها هذا الحديث من كتب الأصول والمقاصد. والمنهج المتبع في هذا البحث هو المنهج العلمي الذي يجمع بين الاستقراء والاستنتاج، ومن أهم نتائج هذا البحث أن هذا الحديث استدل به الأصوليون على أكثر من تسع وعشرين مسألة أصولية، من أهمها حجية السنة والإجماع والقياس، والعمل بالظاهر، والعموم والخصوص، ودليل الخطاب، والمجمل، وبعض مسائل الأمر، والاجتهاد والتعارض بين الأدلة والجمع بينها، والتقليد، وحفظ الدين، وغير ذلك. وكان استدلال الأصوليين بهذا الحديث على هذه المسائل صراحة أو على وجه التمثيل والاستعمال. ومن أهم توصيات هذا البحث جمع هذه المسائل ودراستها- من حيث دلالة هذا الحديث عليها- دراسة موسعة، وكذا العناية بجمع ودراسة المسائل الأصولية التي دلت عليها بعض الآيات أو الأحاديث كحديث (ما نهيتكم عنه فاجتنبوه...) وحديث (إن الله وضع عن أمتي الخطأ، والنسيان، وما استكرهوا عليه).

Drawing inference from Quran and Sunnah is the highest level of inference. The scholars of Islamic jurisprudence and Jurisprudence Principles have always based inference on Quran and Sunnah, emphasizing the authoritativeness of the Consensus (Ijma') and Measurement (Alqias), since the authenticity of any inference must be, in the first place, based on Quran and Sunnah. In this context, the present study attempts to draw inference from Quran and Sunnah for some matters of Jurisprudence Principles, and I have chosen a particular hadith which is "I have been commanded to fight against the people etc." to be the subject matter of this research entitled as "Drawing Inference from the Hadith I have been Commanded to Fight against the People for Jurisprudence Principles". The problem of the study lies in the following question: What are the matters of Jurisprudence Principles that could be inferred from the hadith "I have been commanded to fight against the people, etc."? And what is the line of reasoning for that? Therefore, the topic of the study is the hadith "I have been commanded to fight against the people, etc." and what matters of Jurisprudence Principles that could be concluded from it. The study follows both the deductive and inductive methods. Some of the most important results of the study are: the fact that scholars of Jurisprudence Principles have deduced twenty- nine rulings of Jurisprudence Principles from this hadith, some of which are the authoritativeness of Sunnah, Ijma' and Alqias, the authenticity of the Apparent, the General, the Specific, the Unmentioned in a statement, the Indefinite, some questions of Command, and contrasting evidences and the approaches of compromising them, imitation in religion, and save religion, and many other rulings. That all was used by the scholars of Jurisprudence Principles in the field both theoretically and practically. The most important recommendations of the study are, firstly, searching for and examining the matters and meanings that this hadith carries. Secondly, investigating the matters of Jurisprudence Principles that can be deduced from other certain verses or hadiths, such as "refrain from I forbid you" and "Allah has forgiven my nation for mistakes and forgetfulness, and what they are forced to do".
