المستخلص: لقد أظهرت هذه الدراسة السياسة الموقفية الواجب إتباعها حيال مسألة مهمة من مسائل علم أصول الفقه ألا وهي مسألة التخصيص لعام النص الشرعي بالمصلحة المرسلة، وإسقاطها على فقه العقوبات، وذلك بإتباع المنهج الاستقرائي، والمنهج الاستنباطي، وهذه الدراسة المرسومة بعنوان : (السياسية الموقفية : ودورها في تخصيص عام النص الشرعي العقابي بالاستصلاح المرسل) قد قدمت بيان ماهية الموقفية وأهميتها في السياسة الشرعية الإسلامية، وسماتها، وتأصيلها الفقهي، وعلاقتها بخاصية المرونة في الاجتهاد بالتشريع الإسلامي المتوازن، ثم بيان حقيقة الاستصلاح المرسل، التخصيص، وهل يقوي الاستصلاح المرسل على تخصيص عام النص الشرعي، وذلك من خلال بعض التطبيقات المذهبية في مجال النصوص العقابية.

This study revealed the situational Policy that should be followed in regard to an important one of the issues of the science of the principles of the jurisprudence of Islam, namely the specification of the whole text based on the sharia by determining judgment according to the welfare of the people and its application on the Islamic jurisprudence of punishment, following both inductive and deductive approaches. This study titled "The Situational Policy and Its Role in The Specification of the Whole Punishment Text Based on the Sharia By Determining Judgement According to the Welfare of The People" was presented by showing the significance of the situational aspect and its importance in the policy based on the Islamic sharia, its features, its principles of juris prudence and its relationship with the characteristic of the flexibility of independent judgment in balanced Islamic legislation, followed by an explanation of the real fact of determining judgment according to the welfare of the people together with specification and how will that help in the specification of the whole text based on the sharia through some religious applications in the area of punishment texts.
