المستخلص: تناولت هذه الورقة أثر الحرب على الأطفال ونظام حمايتهم من منظور القانون الدولي الإنساني، واعتمدت الدراسة على جمع المعلومات وتحليلها بهدف الاستفادة منها للوصول إلى نتائج واقعية ومنطقية ذات قيمة علمية قانونية والخروج بتوصيات قابلة للتطبيق على أرض الواقع، جاءت هذه الدراسة لتعالج المشكلة التي يعاني منها الأطفال وهي أن النزاعات المسلحة بشقيها الدولية وغير الدولية تمثل خطرا على الأطفال في العصر الحالي، نظرا إلى النتائج الخطيرة التي لا يمكن تجنبها من قتلهم وتشريدهم، وإشراكهم في الأعمال الحربية، تهدف الدراسة إلى معرفة الآثار المترتبة على الحروب في الوقت المعاصر والتي تهدد حياة كثير من أطفال العالم . توصلت الدراسة إلى عدة نتائج أهمها أن ملايين الأطفال على مستوى العالم لايزالون معرضين لشتى أنواع الأذى والاستغلال وقت الحرب، وأن الحرب لها آثار نفسية واجتماعية واقتصادية تهدد نمو وتطور حياة الأطفال. كما أن اتفاقيات القانون الدولي الإنساني تنص على حظر تجنيد ومشاركة الأطفال في النزاعات المسلحة سواء كانت دولية أم غير دولية حفاظا على الأطفال، إلا أن في كثير من البلدان نجد أن المليشيات المسلحة والجماعات المتطرفة تجند في صفوفها أطفالا دون مراعاة أحكام ومبادئ القانون الدولي الإنساني. وبناء على تلك النتائج توصلت الدراسة إلى عدة توصيات من أهمها، ضرورة الاهتمام بالأطفال لأنهم أمل المستقبل والغد، لذلك فانهم جديرون بالحصول على أفضل حماية وفرص يمكن أتاحتها لهم حتى ينموا في جو من الأمان والاستقرار والعمل على نشر مفاهيم حقوق الطفل وحمايته وزيادة الوعي بها لدى جميع أفراد المجتمع عامة والقوات المسلحة خاصة كما يجب حظر تجنيد الأطفال في القوات المسلحة والجماعات المسلحة والمتطرفة من أجل حماية الأطفال وفي هذا الصدد لابد من إضفاء الصفة الإلزامية على كل اتفاقيات القانون الدولي الإنساني والتي تنص على حماية المدنيين عامة والأطفال خاصة لتكون قابلة للتطبيق على المستوى الدولي الوطني.

The war that inflames every now and then in many parts on earth, has produced a numerous problems, among which comes the problem of children, who represent the main prey who will pay for the faults of the politicians. There fore there was acute necessity for a study to unveil the suitable answers for the children's raised question, so came this paper, which dealt with the impact of war on children and their protection system from the perspective of international humanitarian law. The study relied on data collection and analysis with the aim of benefiting from them to arrive at realistic and logical results of legal scientific value so as to pave the way for recommendations that can be applied on ground. This study deals with the problem faced by children, namely, that armed conflicts, both international and non-international, pose a danger to children in the present era, given the serious and unavoidable consequences of killing ,displacement and involving them in hostilities. The study aims at arriving at the impact of wars that threaten the lives of many of the world's children in contemporary times. The study findings included several results, the most important of which are that millions of children worldwide are still exposed to various types of harm and exploitation during wartime, and that war has psychological, social and economic effects that threaten the natural growth and development of children's lives. Though the International humanitarian law prohibits the recruitment and participation of children in armed conflicts, whether international or non-international, for the protection of children, we still find in many countries, however, armed militias and extremist groups recruit children regardless to the provisions and principles of international humanitarian law. According to the above mentioned results, the study end-product arrived at many recommendations, the most important are: the children are tomorrows generation, so they deserve the best protection and opportunities that can be made available to them so that they develop in secure and stable atmosphere, which helps them to disseminate the concepts of the rights of child and to protect and increase awareness among all members of the community in general and the armed forces in particular. In addition to that, the recruitment of children into the armed forces and extremist groups must be prohibited in order to protect children. In this regard, all international humanitarian law conventions that call for the protection of civilians in general and children in particular should be enforced in order to be applicable at the international and national levels.
