يتجلى دور القاضي الدستوري في الإصلاح التشريعي من خلال دوره في التفسير وهو في معرض أداء اختصاصاته الدستورية ولاسيما الرقابة على دستورية القوانين إذ يهدف القاضي الدستوري من ذلك إلى التقليل من الأحكام الصادرة بعدم الدستورية وذلك من خلال دوره في معالجة الغموض والقصور التشريعي للنصوص القانونية وذلك باتباع أسلوب التفسير القضائي بالإضافة والتي كانت المحكمة الدستورية الإيطالية صاحبة الدور الرائد في هذا المجال ثم اقتفى اثرها كل من المجلس الدستوري الفرنسي والمحكمة الدستورية المصرية ولكن وفقا لقواعد محددة ونطاق محدد. كذلك يعمد القاضي الدستوري وهو في معرض دوره الإصلاحي للتشريعات المطعون بدستوريتها والمنظورة أمامه إلى التفسير القضائي الاستبدالي والذي يهدف من خلاله إلى رفع الجزء المخالف للدستور من القانون المطعون بدستوريته واستبداله بآخر أكثر اتفاقا مع الدستور ولكن هذا كله دون الخروج عن معنى ومضمون النص القاعدي للقانون الطعين خاصة وأن عملية التفسير الدستوري لا تخلط بين النص والقاعدة لأنه النص سابق على عملية التفسير والقاعدة هي نتاج عملية التفسير التي تهدف إلى إعطاء النص معنى وبهذا فإن القاعدة هي النص المفسر أو ثمرة التفسير والقاعدة هي التي يتم تطبيعها فيما بعد، والقاضي الدستوري بهذا الدور حريص كل الحرص على السلطة التقديرية للمشرع فهو يحترم إدارة المشرع ولا يناقضها فيما يقوم به من تفسير بل هدفه تقليل نطاق الأحكام بعدم الدستورية للنصوص القانونية المطعون بدستوريتها أمامه. ولقد تعرضنا في بحثنا هذا إلى تطبيق الدور الإصلاحي التشريعي للقاضي الدستوري في أروقة الأحكام الدستورية الصادرة من المحكمة الدستورية الإيطالية صاحبة الفضل في إرساء دعائم هذا الدور وكذلك المجلس الدستوري الفرنسي.
