|a تكمن أهمية هذا البحث في كون لفظة "مضت السنة" ونحوها من العبارات التي تؤدي معناها من الألفاظ التي أطلقها السلف الصالح - رضوان الله عليهم — على بعض الأعمال، ومعرفة كلامهم مهم جدا لفهم الشريعة التي هم نقلتها. وكون هذه الألفاظ من الألفاظ التي تعطى حكم الرفع لرسول الله صلي الله عليه وسلم. وخرجت النتائج تؤكد أن عبارة مضت السنة ونحوها من العبارات مع التفاوت فيما بينها مفيدة للرفع على الصحيح من أقوال أهل العلم من المحدثين والفقهاء، مع مراعاة المحدثين في هذه المسألة قضية نسبة الخبر إلى قائله أكثر من غيرها، بينهما نجد أن مراعاة الفقهاء لقضية الحجية أكثر. وأن نكاح الحر للأمة جائز متى ما تحققت الشروط. وأنه لا يجوز له نكاح الأمة على الحرة التي يمكنه أن يستعف بها. وأن نكاح الحر للحرة على الأمة نكاح صحيح. وأن الصداق يخفف.

|f The importance of this research lies in the fact that the word “The precedent of the sunnah” and other phrases that serve its meaning from the words that the righteous salaf (predecessors) (may Allaah be pleased with them) used regarding some deeds. Knowing their words is very important to understand the Shariah (Islamic Law) that they have quoted. The fact that these words are one of the words that give the ruling on reaching up to the Messenger of Allaah (peace and blessings of Allaah be upon him). The results show that the phrase ‘precedent of the Sunnah’ and other phrases, while diverging between them, is useful in order to raise the correct view from the scholars, including muhaditheen (scholars of hadith) and scholars of fiqh (jurisprudence). While taking into account the issue of attributing news to the one who says it more than others, we find that fuqaha' (scholars of jurisprudence) are more sensitive to the issue of authenticity. The marriage of the slave woman is permissible when the conditions are met. It is not permissible for him to marry a slave over a free woman, which he can avail himself of. The marriage of the free man with a free woman over a slave is valid. And that the Sidaaq (dowry) is reduced. \nThis abstract translated by Dar AlMandumah Inc. 2018
