|a هذا البحث يعرض الاتجاهين الفقهيين في توريث الإخوة الأشقاء، أو الإخوة لأب، إذا اجتمعوا مع الجد العصبي الصحيح، ويبين أدلة الفريقين من مصادر التشريع المعتبرة، ويناقشها بأسلوب نقدي من حيث معايير كثرة الأدلة، وقوتها في الدلالة على الحكم، وتنوع مصادر الأدلة، ومكانة رجال الفقه، ثم يبين الاتجاه الراجح من هذين الاتجاهين، وأسباب الترجيح، ثم يبين أثر الاختلاف في الإفتاء والقضاء، ليضعه بين يدي أهل العلم من الدارسين والباحثين والمفتين والمقننين العاملين في مجال القضاء وتنظيم الأحوال الشخصية، ليأخذوا بأحسنها.

|b This research presents two jurisprudence tendencies in the inheritance of sibling brothers or half-brothers from father side, if they met with the right grandfather. The research shows the proofs of the two different groups from significant legal sources. It discusses critically the two groups' opinions in regards to numbers, validity of evidences, and their strength in pointing out the ruling of the matter, variation of evidences sources, and the position of fiqh scholars. Also, it shows the preponderant opinion of the two, and the reasons for preferring one of them, then it illustrates the impact in order to make people of education, students, researchers, muftis, legislators to choose the better one.
