المستخلص: This study dealt with the moral personality of the account of policyholders of the Islamic insurance in terms of how they were established and the reasons for their existence, and to determine the characteristics of the Moral personality and its characteristics in the account of the policyholders, the extent to which they achieved reality, and the extent to which Islamic jurisprudence accepted these characteristics and characteristics, selected models of Islamic insurance companies. The study concluded to determine the constituents of the moral personality of the account holders in terms of the objective and formal elements and independence, and eligibility. While the characteristics of the moral personality are represented by the following: the right to litigation, nationality and domicile, a deputy representative, and a name. The research showed the availability of two elements of moral personality in part, and the unavailability of some characteristics of moral personality and its components in the accounts of the account of Policyholders in full. The research recommends completing the construction of this character in accordance with an appropriate Moral formula, preparing a model for the documentation system for the document holders, and finding an appropriate format for representing the document holders.

تناولت هذه الدراسة الشخصية الاعتبارية لحساب حملة وثائق التأمين الإسلامي من حيث التعرف على كيفية نشأتها وأسباب وجودها، وصولا إلى تحديد مقومات الشخصية الاعتبارية وخصائصها في حساب حملة الوثائق، ومدى تحققها فيه واقعا، ومدى قبول الفقه الإسلامي لهذه المقومات والخصائص، ومن ثم إجراء دراسة تطبيقية على نماذج مختارة من شركات التأمين الإسلامي. وتوصلت الدراسة إلى تحديد مقومات الشخصية الاعتبارية لحساب حملة الوثائق بالعنصر الموضوعي والشكلي، والاستقلالية، والأهلية. في حين أن خصائص الشخصية الاعتبارية تتمثل بالآتي: حق التقاضي، والجنسية والموطن، ونائب يمثله، والاسم. وأظهرت الدراسة توافر عنصري الشخصية الاعتبارية جزئيا، وعدم توافر بعض خصائص الشخصية الاعتبارية ومقوماتها في حساب حملة الوثائق كليا. وتوصي الدراسة بإكمال بناء هذه الشخصية وفقا لصيغة قانونية مناسبة، وإعداد نموذج لنظام أساسي لحساب حملة الوثائق، وإيجاد صيغة مناسبة لتمثيل حملة الوثائق.
