المستخلص: تعتبر جريمة الاغتصاب في الشريعة الإسلامية من الحدود التي لا يجوز إسقاطها أو العفو فيها لا من الفرد ولا من ولي الأمر، لما في هذه الجريمة من اعتداء على الأعراض والأنساب، ومع هذا فقد وقع خلاف بين فقهاء الشريعة الإسلامية على نوع الخد الذي يقع على الجان، هل حد زنا أم حد حرابة؟
لكي نعتبر الفعل زنا ويقام الحد على الجاني يجب أن يصدر فعل الزنا من طرفين كلاهما راض رضا تام على ارتكاب الفاحشة، لهذا وجب التفريق بين من يرتكب الزنا بالرضى وبين من يرتكب الزنا وهو موقع الطرف الآخر تحت الإكراه والتهديد، فليس من العدل أن بجعل لكلاهما ذات العقوبة، كما إن جريمة الزنا تحتاج في إنباتها إلى شروط لا تكاد تتوفر إلا نادرا وهذا يؤدي إلى إفلات الجاني من العقاب حدا.
وبما أن المحارب هو الذي يعيث في الأرض فسادا، وليس هناك فساد أكبر من إفساد العرض والنسل، لأن الاعتداء على أعراض الناس أخطر وأبشع من الاعتداء على أموالهم، لهذا فإن كل من ينتهك أعراض الناس كرها وغصبا فهو محارب.


Rape crime in Islamic law is considered part of the “Hudood [crimes whose punishment is set out by Allah,” which neither the individual nor the guardian can drop or pardon because this crime involves an attack on the dignity and genealogy. However, there has been a disagreement among the Fuqaha' of Islamic Sharia over the type of "Hadd [punishment] that shall be applied to the one who committed the crime. Would it be the "Hadd" of committing adultery or “Hirabah [Unlawful warfare]?
Considering the commission of an act as adultery and punishing the perpetrator, the adultery must be committed by two parties, both of whom shall be fully consenting to the commission of this outrageous act.
Therefore, a distinction must be made between the one who commits adultery by consent and the one who commits it and happens to be the other part of the act, under duress and threats. It is not fair to give both of them the same punishment. Proving the offense of adultery requires conditions that are rarely met, and this leads to impunity for the perpetrator from [Hadd].
Since it is the "Muharib" who makes corruption on earth, and there is no greater corruption than the corruption of dignity and lineage, because it is more dangerous and heinous to attack people's dignity than to attack their property, that is why anyone who violates people's dignity involuntarily and against their will is a “Muharib.”
