المستخلص: تناول البحث منصب رئيس الدولة في النظام السياسي الإسلامي مبينا طرق إسناد السلطة إليه، ومشروعية هذا المنصب وتكييفه الفقهي. كما تناول طاعة رئيس الدولة مبينا حكمها والقيود التي ترسم حدودها. ويهدف البحث إلى الوصول إلى التكييف الفقهي لمنصب رئيس الدولة في نظام الحكم في الإسلام، باستقراء وتحليل طرق إسناد السلطة إليه، مع المقارنة بأبرز النظم السياسية المعاصرة. كما يهدف إلى استنباط الحدود المقيدة لطاعة الرؤساء بعد بيان مشروعيتها، باتباع المنهج التحليلي للنصوص الشرعية والتراث الفقهي، مع مقارنتها بحق طاعة الرؤساء في الدراسات القانونية.
وخلص البحث إلى أن الأصل في إسناد السلطة إلى رئيس الدولة في نظام الحكم في الإسلام هو اختدار الأمة ورضاها. وأن الراجح في تكييف منصب رئيس الدولة في النظام السياسي الإسلامي أنه نائب عن الأمة، وأن نيابته عنها من قبيل الوكالة. وأن طاعة رئيس الدولة في النظام السياسي الإسلامي بالمعروف مشروعة وحكمها الوجوب، وأن هذه الطاعة ليست مطلقة؛ إذ لا تنبغي الطاعة المطلقة إلا لله تعالى، وإنما هي محددة بثلاثة قيود، تتلخص في أن طاعته لا تشرع فيما كان معصية لله تعالى، ولا تجب فيما يخرج عن إطار السياسة وتدبير الشؤون العامة، ولا فيما لا تتحقق به مصلحة.


The research dealt with the position of Head of State in the Islamic political system, explaining ways of assigning power to him, the legitimacy of this position and its jurisprudence characterization. It also addressed the matter of obedience to the Head of the State, indicating its ruling and the restrictions that mark its borders. The research aims to arrive at the jurisprudence characterization of the position of the Head of State in the governance system in Islam by extrapolating and analyzing ways of assigning power to him, compared with the most prominent contemporary political systems. It also aims to draw the limits of obedience to superiors after explaining its legitimacy, by following the analytical approach to sharia texts and the jurisprudence heritage, while comparing them with the right of obedience to superiors in legal studies.
The research concluded that the basic principle in assigning power to the Head of State in the Islamic governance system is the authority of the Ummah and its consent. The most correct view of adapting the position of Head of State in the Islamic political system is that he is a representative of the Ummah and that his representation of Ummah is of agent nature. Obeying the head of state in the Islamic political system in virtues is legitimate and obligatory. However, this obedience is not absolute, as absolute obedience should only be to Allah, may He be exalted. Rather it is restricted by three elements, which can be summarized as being obedient to him does not permit for what is disobedience to Allah, may He be exalted, it is also not obligatory in matters that are outside the framework of politics and the management of public affairs, or in which no interest is achieved.
