تناول الباحث في هذا البحث تعريف الدية، وبين مشروعيتها على ضوء القرآن الكريم والسنة النبوية المطهرة، ثم بين مقدار دية القتل العمد والخطأ، كذلك دية أعضاء الإنسان والجروح التي تصيب جسمه، ثم بين مقدار دية والجنين الذي يُسقط من بطن أمه ميتا، متعرضا لآراء الفقهاء واختلافاتهم حول مقادير الدية، ثم بيان القول الراجح من تلك الآراء. والهدف من هذا البحث هو توضيح الرأي الأقرب إلى الصواب، وأن الإسلام نظام كامل شامل للحياة، له في كل قضية حكم وعلاج كاف شاف. وتتمثل أهمية هذا البحث وأسباب اختياره في أنه يتعلق بالمحافظة على حياة الإنسان، بالإضافة إلى بيان رأي فقهي واضح، يستعين به الحكام والقضاة على تبني مقدار للدية يليق بعظمة الإنسان، وفي الوقت نفسه يكبح جماح المتفلتين ويشفى غيظ قلوب المكلومين. واستخدم الباحث المنهج الاستقرائي التحليلي، حيث قام بتتبع آراء الفقهاء واختلافاتهم حول الدية، ومن ثم دراستها وتحليلها ناسبا تلك الآراء إلى قائليها. واشتمل البحث على مقدمة وأربعة مباحث وخاتمة. وتوصل الباحث إلى عدة نتائج أهمها: أن القرآن الكريم لم يتعرض لبيان مقادير الديات، وإنما بينتها السنة النبوية المطهرة، وأن الفقهاء اتفقوا على أن الإبل أصل من أصول الدية واختلفوا فيما سواها. واوصى الباحث الدارسين والباحثين بإكمال النقص وتصويب الخطأ في هذا البحث. وختم الباحث دراسته بذكر المصادر والمراجع التي اعتمد عليها.
This thesis identifies blood money and explains its justifications in the light of the Holey Quran and the Teaching of the Prophet (peace be upon him); it also explains the amount of blood money paid for intended and accidentally killing as well as human organs' blood money and wounds on his body. In addition to an explanation of the woman's blood money amount and the dead fetus resulted by abortion; the blood money amount of disbelievers in Muslim countries as it shows the correct view amongst scholars' views about other counted amounts instead of camels. The aim of this research is explaining that Islam has set a complete and comprehensive system for the life, in which every case has its legislation and solution. The importance of this research is that it relates to the issue of life's saving. In addition, many man-made laws could not be able to identify the suitable amount of blood money that would stop murderers and satisfy victim's relatives. The researcher adopts the inductive analytical approach; he followed the verses of Holey Quran and the Prophet Teachings that relates to this cases; he reviews commentators and scholars points of view with all documentation and references. The research includes an introduction, four chapters and conclusion. Moreover, many results were reached; most important are: the amounts of blood money were accurately explained in the Prophet's Teachings, scholars were all agreed with the amount of blood money which is hundred camel for the man and half of it to be considered woman's blood money. The researcher recommends following researchers to complete any shortage they see in this thesis and recorrect mistakes if found. Lastly mentioned were all sources and references depended on to prove points.
