المستخلص: إن الأنكحة الفاسدة هي الأنكحة التي حرمها الله سبحانه وتعالى في كتابه والنبي صلى الله عليه وسلم في سنته ودلت عليها أقوال أهل العلم. أنواع الأنكحة الفاسدة: الأنكحة المتفق على فسادها مثل: المحرمات بسب النسب، المصاهرة، الرضاع، الكافرة من غير أهل الكتاب، نكاح المحصنة، نكاح الخامسة، نكاح المتعة. الأنكحة المختلف على فسادها: مثل: نكاح الشغار، نكاح التحليل، نكاح المريض، نكاح المحرم، نكاح السر، نكاح بلا ولي أو بلا شهود.... الخ تطبيق مراعاة الخلاف على نكاح الشغار: ووجه مراعاة الخلاف في هذا هو قول المالكية أن وجه نكاح الشغار يفسخ استحبابا، وإن وقع الفسخ يكون بطلاق، وأن صريح نكاح الشغار يفسخ أبدا، لكن فسخه يكون بطلاق. -تطبيق مراعاة الخلاف على نكاح المحلل: ونكاح المحلل فاسد مفسوخ يفسخ قبل الدخول وبعده بطلقة بائنة وذلك مراعاة للخلاف فيه ولها المهر المسمى بالدخول وهو أن يتزوج امرأة طلقها غيره ثلاثا ليحلها لزوجها وهذا الذي ورد فيه الحديث عن النبي صلى الله عليه وسلم بلعنه وإنما يجب أن يكون نكاحه منها نكاح رغبة لا قصد فيه للتحليل. تطبيق مراعاة الخلاف على نكاح المريض مرض الموت: أن المالكية ضيقوا من إعمال مراعاة الخلاف، فأعملوها في إثبات الصداق وقالوا يثبت صداق المثل، ولكن لم يطبقوها في مسألة الميراث، فقالوا: تمنع المرأة من الميراث ولو دخل بها خلافا لمذهبهم في الأنكحة المختلف فيها بثبوت التوارث لأن الأصل منع هذا النكاح هو علة إدخال وارثا جديدا.
