|a التجارة من أكثر القطاعات استجابة للتقدم التكنولوجي، وأوسعها استخداما للتقنيات الحديثة والمتطورة، هذه الأخيرة تعد محور تحول تجاري، نتج عنه تغير عميق في سلوك المتعاملين وفي قواعد المعاملات التجارية، حيث ظهر نوع جديد من المبادلات التجارية اصطلح عليه بالتجارة الإلكترونية، أفرزته شبكة التواصل الاجتماعي وفرت له الوسائل الخاصة به والتي تتناسب مع طبيعته، وأضحت هذه الشبكة سوقا وطنية ودولية افتراضية غير عادية، نظرا لما تمتاز به التجارة الإلكترونية من المردود الحسن والفعال، واختصارا للوقت وتوفيرا في التكاليف. ومن بين أدوات التجارة الإلكترونية تلك العقود التي تبرم عبر الوسائط الإلكترونية عن بعد، والتي تدعى بالعقود الإلكترونية وطرفاها هما المستهلك والمتدخل الإلكتروني.
