يتناول هذا البحث قادحا مهما من قوادح القياس، وهو قادح الفرق، والتطبيق عليه من الأقيسة في مسائل أصول الفقه، وقد حصر الباحث من ذلك ما يقارب مائة قياس مقدوحا فيها بذلك، ونظرا لمحدودية البحوث التي تنشر في المجلات العلمية رأى الاقتصار من ذلك على مسائل الحكم، فجعله تحت عنوان: أثر الفرق على الاحتجاج بالقياس في مسائل الحكم. وقد حوى البحث مقدمة، وتمهيدا، وثمانية مباحث، ففي التمهيد: تم التعريف بالفرق، والقياس، والحكم، وبيان أثر الفرق في حجية القياس. وفي المبحث الأول عرض الباحث: أثر الفرق على الاحتجاج بالقياس في مسألة إثبات الواجب الموسع، والمبحث الثاني: أثر الفرق على الاحتجاج بالقياس في مسألة توجه الخطاب في الواجب المخير، والمبحث الثالث: أثر الفرق على الاحتجاج بالقياس في مسألة سقوط الواجب بفوات وقته، والمبحث الرابع: أثر الفرق على الاحتجاج بالقياس في مسألة كون المندوب حكما تكليفيا، والمبحث الخامس: أثر الفرق على الاحتجاج بالقياس في مسألة لزوم المندوب بالشروع فيه، والمبحث السادس: أثر الفرق على الاحتجاج بالقياس في مسألة كون المكروه حكما تكليفيا، والمبحث السابع: أثر الفرق على الاحتجاج بالقياس في مسألة حكم الأعيان المنتفع بها، والمبحث الثامن: أثر الفرق على الاحتجاج بالقياس في مسألة خطاب الكفار بفروع الشريعة. وقد اتضح من خلال البحث أن قادح الفرق حجة ومعتبر، ومؤثر في القياس على رأي جماهير أهل العلم من الأصوليين والفقهاء، وأنه ورد على عدد من الأقيسة الأصولية في مسائل الحكم فأدى إلى بطلان القياس في غالبها.
Research Title: The Effectiveness of Difference on protestation By Analogy in Judgment Issues. This research examines an important disparagement of the analogy which is the difference, and the application of other analogies in the issues of the principle of jurisprudence. The researcher listed about one hundred disparaged analogies. Given to the limited researches which publish the limitation opinion about the judgment issues in the scientific magazines, the researcher entitled the research as follows: The Effectiveness of Difference on protestation By Analogy in Judgment Issues. The research plan includes an introduction, preface, eight topics. The preface examined the definition of difference, analogy and judgment; and demonstrated the effectiveness of the difference in the opposability of the analogy. The first topic examined the effectiveness of the difference on the protestation by analogy on the expanded obligation issues. The second topic examined the effectiveness of the difference on the protestation by analogy in the speech orientation towards the voluntary obligation. The third topic examined the effectiveness of the difference on the protestation by analogy in forfeiture of the time-barred obligation. The fourth topic examined the effectiveness of the difference on the protestation by analogy in case the recommended deed issue is a compulsory judgment. The fifth topic: examined the effectiveness of the difference on the protestation by analogy in case the recommended deed issue must be commenced. The sixth topic examined the effectiveness of the difference on the protestation by analogy in case the disapproved deed issue is a compulsory judgment. The seventh topic examined the effectiveness of the difference on the protestation by analogy in the issue of the judgment of the used objects. The eighth topic examined the effectiveness of the difference on the protestation by analogy in the issue of addressing the disbelievers with the branches of Sharia. This research revealed that the disparagement of difference is considered a considerable evidence and influencing on the analogy as perceived by the consensus of Muslim Fundamental and Juristic Scholars. This is applied to a number of fundamental analogies in terms of judgment issues, but led to the nullification of the analogy at the most.
