|a يتناول هذا البحث تحديد من يتحمل التعويض عن خطأ الطبيب أثناء ممارسته لمهنته، وبيان أقوال الفقهاء في ذلك، حيث صنفت أعمال الطبيب أثناء ممارسته لمهنته، ثم حددت الحالة التي تصنف بأنها خطأ يقع من الطبيب، وبعد ذلك بينت أقوال الفقهاء ومناقشاتهم، ثم انتهى البحث إلى أن من يتحمل التعويض عن خطأ الطبيب إن كان قليلا هو الطبيب، وإن كان كثيرا تتحمله عاقلة الطبيب، وهم أقاربه، أو أهل حرفته ونقابته، فإن لم يكن له عاقلة تحملته الدولة، ويجوز للدولة أن تجعل أي ترتيب إداري ليتعاون الأطباء فيما بينهم في دفع التعويض، كالنقابات أو الإلزام بالتسجيل في شركات التأمين التعاوني، وغير ذلك.

|b This research deals with determining who bears compensation for doctor’s error during medical practice. It also states the views of scholars (fuqaha) in this issue. The research classifies the doctor’s medical practice, identifies situations that are classified as errors of the practitioner; and thereafter explains the views and discussions of scholars in this issue. The research comes to the conclusion that if the compensation for the medical practitioner’s error is too little, it is borne by the practitioner, but if it is too much it will be paid by their relatives (aqila), or people of their career, or their union, according to the prevailing customs. If the practitioner has no aqila the state pays it. The state may make administrative arrangement, such as unions, to enable doctors to cooperate in compensation payment, or it may oblige them to join the cooperative insurance companies, etc.
