|a هذا بحث بعنوان «تشبه المسلم بالكافر: أحواله وأحكامه - دراسة فقهية» يسعى إلى حل مشكلات؛ منها: البحث عن حدود استفادة المسلم من الكافر وضوابطها، والتنقيب عن نظر الفقهاء إلى قضية تشابه فعل المسلم مع الكافر في فروعهم الفقهية في العبادات والعادات، وهل لقصد التشبه أو عدمه أثر في اختلاف الفقهاء في العبادات والعادات؟ \nولقد اتبعت عدة مناهج بحثية؛ وهي المنهج الاستقرائي؛ حيث تتبعت الجزئيات، كما استخدمت المنهج الوصفي التحليلي بربط وتفسير المعلومات. \nكما استعنت بالمنهج الاستدلالي بالانتقال من قضايا مسلمة إلى قضايا أخرى تنتج عنها بالضرورة. وكان من نتائج البحث: بيان أن عبادات وعادات الكفار وتقاطعها مع عبادات وعادات المسلم ليست على درجة واحدة، ولا على حكم واحد عند سلف الأمة وعلمائها، والكشف عن دقائق نظر الفقهاء إلى قضية تشابه فعل المسلم مع الكافر في فروعهم الفقهية في العبادات والعادات.\n

|f This research titled “Muslim imitating the Kaafir (Non-Believer): its conditions and rulings- a jurisprudence study” seeks to solve some problems; including: \nLooking at the limits of the Muslim benefiting from a Kaafir and its regulations. Exploring the view of the scholars of jurisprudence concerning the issue of the similarity of the act of the Muslim with the Kafir in acts of religion and customs according to their jurisprudential branches. Does the intention of imitating or non-imitating affect the difference of scholars in religious acts and customs?\nI followed several research approaches, including the inductive approach, which traced the small details. I also used the descriptive analytical approach in order to link and interpret the information.\nI also benefited from the evidentiary approach to move from Muslim issues to other issues that necessarily result from it. \nThe study results showed: \nIt outlined that the worships and customs of the Kuffaar (Non-believers) and their similarity with the worships and customs of the Muslims are not of equal grade nor have one ruling, according to the early scholars of Ummah. \nIt also revealed the details of the view of the scholars concerning the issue of the similarity of the act of the Muslim with the Kafir, in their jurisprudential branches in the acts of religion and customs.\nThis abstract translated by Dar AlMandumah Inc. 2018
