|a تقوم فكرة حماية البيئة في الإسلام على أساس عقدي، فقد اعتبرت الحفاظ على البيئة ورعايتها من القرب التي يتقرب بها إلى الله تعالى، وجعلت هذه الرعاية جزءاً من العقيدة، وبهذا تضيف الشريعة إلى البعد القانوني والتشريعي بعداً آخر وهو البعد التعبدي، مما يدفع المسلم على سرعة الامتثال لهذه الأحكام. ومما لا شك فيه أن الجهود التي تبذل في مجال حماية البيئة، وصيانتها في إطار التشريعات والقوانين الوطنية لا يمكن أن تؤتي ثمارها، وذلك ما لم تقترن بجهود أخرى على مستوى الصعيد الدولي، وذلك لأن البيئة من المجالات، التي نجد فيها ارتباطاً وثيقاً إلى أقصى مدى، بين القانون الوطني والقانون الدولي.
