| 520 | |a اهتمت الشريعة الإسلامية بمصالح الخدم، ودفعت المشقة ورفعت الإحراج عنهم، بغض النظر عن كيفية تغير الظروف والأوقات والأماكن تختلف، تتوافق روح التشريع مع أحكام القضايا العارضة لحياة البشرية، وفقًا لمصالح الناس بموجب النهج الشرعي. وأهداف الشريعة هي الإطار الذي يجب أن يتابع عليه المجاهدون عند النظر في حالات الطوارئ والجزيئات والحوادث الناشئة. ومن أعظم اهتمامات الشريعة هو الحفاظ على الأغراض الأساسية التي تقوم عليها حياة البشرية، سواء كانت بجانب الضرورات أو المتطلبات أو الكماليات، وهذا يؤكد شمولية الشريعة الإسلامية وقدرتها على استيعاب كل ما هو جديد. فمن الشريعة أن نحقق مبدأ السهولة والبساطة والعناية بمصالح الخلق "التفويض" الذي يدخل ويستجيب للعديد من الأحكام في ظروف خاصة، وقد تستجيب هذه التراخيص للاحتياجات وتستجيب للمتطلبات والكماليات. ولأهمية هذا الموضوع، أود المساهمة في بيان العلاقة بين التراخيص وأغراض الشريعة، وكيف يمكن تحقيقها لهذه الأغراض على مستويات مختلفة. ويتكون البحث من مقدمة وثلاثة فصول وخاتمة تتناول التعريف والضوابط والشرعية وأنواع التراخيص، ثم تُظهر معنى المقاصد ودرجاتها والأدلة على نظرها. ثم أنهى البحث بالإشارة إلى العلاقة بين أغراض الشريعة والترخيص. | ||
| 520 | |b The Islamic sharia took care of the interests of the servants, pushed the hardship and lifted the embarrassment of them, No matter how the circumstances change and the times and places differ, the spirit of the legislation corresponds to the provisions of the issues that are incidental to the life of mankind, in accordance with the interests of the people under the sharia approach. The purposes of sharia are the framework on which those who are diligent should proceed when considering the emergency and emerging particles and incidents. One of the greatest interests of the Shariah is to preserve the basic purposes on which the life of mankind is based, whether it be on the side of necessities, requirements or luxuries. This confirms the comprehensiveness of Islamic Sharia and its ability to absorb all new. It is the law of Allah to achieve the principle of ease and simplicity and to care for the interests of creation "Authorization" which enter and respond to many provisions in special circumstances, these authorizations may respond to necessities and they respond to the requirements and luxuries. Because of the importance of this topic, I would like to contribute to the statement of the relationship between authorizations and the purposes of Sharia, and how it can be realized for these purposes at different levels. The research consists of an introduction, three chapters and a conclusion, which deals with the definition, controls, legality and types of a authorizations, and then showed the meaning of the purposes, their grades and the evidence of their consideration. Then terminated the research by indicating the relationship between the purposes of Sharia and authorization. | ||
