المستخلص: إنه لما كان بيع الاستجرار ظاهرة في كل عصر ومصر، أردت دراسته لمعرفة صوره وأحكامه الفقهية وتطبيقاته المعاصرة في المعاملات المصرفية في بحث بعنوان: (بيع الاستجرار وتطبيقاته المعاصرة في المعاملات المصرفية). أهمية البحث: لقد لوحظ اطراد انتشار بيع الاستجرار في المجتمعات الإسلامية، فكان اختياري لهذا الموضوع كمحاولة لدراسة هذا النوع من البيع لمعرفة صوره وأحكامه الفقهية وتطبيقاته المعاصرة في المعاملات المصرفية. منهجية البحث: سيتم تناول البحث ضمن محورين: الأول: نظري والثاني: وصفي تحليلي، ويشتمل على مقدمة، وتمهيد، ومبحثين، وخاتمة، وفهارس. أما المقدمة: فقد تحدث فيها الباحث عن أهمية الموضوع، وأهم أسباب اختياره له، والدراسات السابقة، ومنهج البحث، وخطته. وأما التمهيد: ففي تعريف البيع لغة وشرعاً، وحكمه، وأدلة مشروعيته، وحكمة مشروعيته، وآدابه، وأركانه، وشروطه. وأما المبحث الأول: ففي بيع الاستجرار، وفيه ثلاثة مطالب: المطلب الأول: في تعريف الاستجرار، والمقصود ببيع الاستجرار، وأسمائه وسبب التسمية، وتعريف البيع بالتعاطي، والفرق بينه وبين بيع الاستجرار. المطلب الثاني: في صور بيع الاستجرار. المطلب الثالث: في حكم بيع الاستجرار. وأما المبحث الثاني: ففي بيع الاستجرار وتطبيقاته المعاصرة في المعاملات المصرفية وفيه أربعة مطالب: المطلب الأول: في حقيقة بيع المرابحة للآمر بالشراء وتكييفها الفقهي. المطلب الثاني: في تطبيق بيع الاستجرار في عقد المرابحة للآمر بالشراء. المطلب الثالث: في تطبيق عقد الاستجرار في مجال تقديم خدمة الدفع المسبق. المطلب الرابع: في تطبيق عقد الاستجرار في مجال التمويل المالي. الخاتمة: وفيها أهم النتائج التي توصلت إليها، والتوصيات. فهرس المصادر والمراجع.

Praise be to Allah, the Lord of the Worlds, and prayers and peace be upon the noble prophets and messengers of our master Muhammad, and on his family and companions and those who follow them in charity until the Day of Judgment. Because the sale of the eviction phenomenon in every era and Egypt, I wanted to study to know its forms and jurisprudence and its contemporary applications in banking transactions in the research entitled (the sale of investment and its contemporary applications in banking transactions) Research importance: It has been noticed that the spread of ignorance in Islamic societies has become increasingly widespread. I have chosen this subject as an attempt to study this type of sale to know its forms and jurisprudence and its contemporary applications in banking transactions. Research Methodology: The research will be dealt with in two axes: the first: theoretical and the second: descriptive analytical, and includes an introduction, and the preparation, and two papers, and the conclusion, and indexes. The introduction: The researcher talked about the importance of the subject, the main reasons for his selection, previous studies, research methodology, and plan. As for the preamble: In the definition of selling a language and Sharia, its ruling, and the evidence of its legitimacy, the wisdom of its legitimacy, its etiquette, its pillars, and its conditions. As for the first topic: In the sale of renting, in which there are three demands: The first requirement: is to define the transaction, and it is intended to sell the estate, its names, the reason for the designation, the definition of the sale by dealing with it, and the difference between it and the sale of the leasing. The second requirement: In the sale of the renting. The third requirement: In the ruling on selling the land. As for the second topic: In the sale of investment and its contemporary applications in banking transactions, and there are four demands: The first requirement: the fact that the Murabaha sale of the purchase order and its adaptation to the jurisprudence. The second requirement: In the application of the sale of the contract in the Murabaha contract for the purchase order. Third requirement: In the application of the contract of hire in the field of providing prepaid service. The fourth requirement: In the implementation of the leasing contract in the field of financial finance. Conclusion: It contains the most important findings and recommendations.
