المستخلص: بهدف التجسيد الميداني الصحيح للاستثمارات والمشاريع العمومية والتي تكون الصفقات العمومية هي البوابة الأولى له ومن أجل حماية المال العام، قام المشرع الجزائري بإصدار المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، متبيناً صورة جديدة للرقابة على العمليات التي تنجز عبر الصفقات العمومية من خلال أحكام من شأنها أن تعزز الرقابة في المجال حيث تم استحداث جهاز رقابي وفق ما يتطلبه القانون العام الاقتصادي، والمتمثل في سلطة ضبط مستقلة في مجال الصفقات العمومية. إلى جانب ذلك تم تعديل بقية الأجهزة وذلك من أجل إعطاء صورة مغايرة للهيئات الرقابية الأخرى والتي تمثلت عموماً في الأجهزة الداخلية والخارجية وذلك للوقوف أمام كل التجاوزات الخاصة بنهب أموال الدولة وللحد الفساد بكل أشكاله.

In order to implement accurately public investments and projects through public procurement, the Algerian legislator has issued the presidential decree 15- 247 related to the regulation of public procurements and public services delegation, adopting a new form of control over the projects carried out through public procurements, and throughout rules that could strengthen the control on the field. Hence, as required by the public economic law; a new control agency was created, presenting an independent regulatory authority in the public procurement domain. Furthermore, an adjustment of other control agencies, namely the internal and external ones, has been carried out for the purpose of fighting public funds looting and reducing all forms of corruption.

Pour que les investissements et les projets publics soient correctement incarnés sur le terrain, et dans le but de protéger les deniers publics, le législateur algérien a promulgué le décret présidentiel n° 15- 247, portant sur la règlementation des marchés publics et des délégations du service public, en adoptant une nouvelle forme de contrôle sur les opérations effectuées par le biais des transactions publiques à travers des dispositions qui renforceraient le contrôle dans le domaine et où un organe de contrôle a été créé conformément au droit économique général, qui est une autorité de contrôle indépendante en matière des marchés publics. En outre, les autres agences ont été modifiées afin de donner une image différente des autres organismes de réglementation, généralement représentés par des organes internes et externes, afin de faire face aux abus des fonds publics pillés et lutter contre la corruption sous toutes ses formes.
