المستخلص: تطرقنا من خلال هذا البحث إلى تقنية متصلة اتصالا وثيقا بتسيير المرفق العام، ألا وهي عقود تفويض المرفق العام الذي يعد إجراء قانوني تعهد من خلاله السلطة المفوضة بما يندرج تحت اختصاصها ومسؤوليتها، للمفوض له بإدارة واستغلال مرافق عامة، مع أو بدون إنجاز منشآت واقتناء ممتلكات، لتنفيذ المرفق العام واستغلاله، لمدة محددة من الزمن، مع رقابة كلية أو جزئية يخضع لها صاحب التفويض. كل ذلك مقابل عائد مالي مرتبط بنتائج الاستغلال. نستعرض في هذا المقال مفهوم هذه التقنية ونبين عناصرها من منظور الفقه والقانون، ونوضح شروط قيامها، والأشكال التي تتخذها وفق ما نص عليه المشرع مع تبيان تعريف كل تطبيق منها وذكر خصائصه.

through this research, we have touched upon a technique closely related to the management of the public facility, namely the contracts for the delegation of the public facility, which is a legal procedure through which the delegated authority undertakes what falls under its competence and responsibility, to the delegate to manage and exploit public facilities, with or without the completion of facilities and the acquisition of property, To implement and exploit the public facility, for a specified period of time, with total or partial control to which the authorization is subject. All this in return for a financial return related to the results of the exploitation. In this article, we review the concept of this technology and explain its elements from the perspective of jurisprudence and law, and explain the conditions for its establishment, and the forms it takes according to what the legislator stipulated, with an explanation of the definition of each application and mentioning its characteristics.
