المستخلص: إن هذا البحث يهدف إلى دراسة غطاء الحشد الشعبي القانوني في الدستور العراقي في ظل الظروف التي يتعرض لها العراق. وقد تضمن هذا البحث ثلاثة مباحث أساسية: تناول المبحث الأول التنظيم القانوني للحشد الشعبي. بينما المبحث الثاني قوانين التجنيد الإلزامي والحرس الوطني ومؤسسة الشهداء والحشد الشعبي، أما المبحث الثالث فقد تناول التأييد القانوني للحشد الشعبي في ظل القانون الدولي الإنساني. وقد توصل هذا البحث إلى جملة من النتائج، كان من أهمها: أن "تشريع قانون يحمي فصائل الحشد الشعبي سيحفظ حقوق الجميع بما في ذلك حقوق أبناء العشائر التي انضوت تحت لواء الحشد الشعبي: وأن "القانون يجب أن يحفظ حقوق الأهالي في حال تعرضهم للاعتداء والانتهاك من قبل متطوعي الحشد الشعبي". كما توصل البحث إلى عدد من المقترحات، كان من أهمها: التأكيد على ضرورة تعديل الدستور أو كتابة دستور جديد تتلاءم مواده فيما بينها، بما تقتضي مصلحة الشعب العراقي بكل مكوناته لا بما تقتضي مصالح الأحزاب والعوائل والشخصيات المتنفذة.

This research aims to study the legal cover of popular mobilization in the Constitution and international humanitarian law under the circumstances facing Iraq. The study included three basic topics: the first topic dealt with the legal organization of the popular mobilization. While the second topic dealt with the laws of compulsory recruitment and the National Guard and the institution of martyrs and popular mobilization, while the third topic dealt with legal support for popular mobilization under international humanitarian law. This study has reached a number of results, the most important of which is: "The enactment of a law that protects the grassroots factions will preserve the rights of all, including the rights of tribesmen who have joined the popular mobilization." The law should protect the rights of residents in the event of abuse and violation by volunteers of the popular crowd. " The study also reached a number of proposals, the most important of which was the following: Emphasizing the need to amend the constitution or to write a new constitution compatible with each other, so as to require the interests of the Iraqi people in all its components, not to the interests of parties, families and influential personalities.
