المستخلص: Individual began from the beginning of the 20th century to acquire legal status as one of the entities that has been regulated by international law, therefore individual became a legal international personal which can enjoy rights and obligations. Creating and developing of international criminal law are legal rules that regulate an essential issues related to international relationships, including maintaining international peace and security, prevention of serious violations to fundamental rights and freedoms that affects relations between countries or between individuals and their countries, and also to develop cooperation among countries it was important to face and fight international crimes and punish guilty persons who infringe international laws rules International criminal law can be defined as a set of roles that determine acts that can consider an international crimes and determine criminal procedures that must be taken when international crimes are be committed. So it’s an international features law according to modern concept of international law. Due to modernity and importance of international criminal law, jurists differed about its concept and its relation with national, international and human law therefore jurists views had been discussed, furthermore fundamental sources of international criminal law had been clarified.
