المستخلص: تهتم هذه الدراسة بالأعراف والعادات ودور التشريعات والقوانين في تغييرها في كثير من القضايا التي تهم المجتمعات في مختلف الأزمنة والأمكنة، وتضع الضوابط والأحكام التي تضبط حركة المجتمع في إطار تفاعله مع الجوانب المستجدة في حياة الناس المعاصرة للنهوض بالمجتمع، ودفع عملية التنمية فيه، فالعادات التي سار عليها الناس واطمأنوا لها وأصبحت ديدنا وعرفا واستقرت في حياتهم، تحتاج إلى ضبط وتنظيم في مختلف جوانبها ومجالاتها الصحية والاجتماعية والاقتصادية وغيرها بضوابط الشرع، لإيجاد الأحكام والقوانين والتشريعات التي تنظم وتعالج ما استجد فيها من نوازل ومستجدات، لتقوم مصالح الدين والدنيا على الاستقامة، وتعريف الناس بالأحكام الفقهية في الوقائع والنوازل التي ترتبط بمسايرة أوضاعهم وتنظم شؤون حياتهم وتربطهم بعقيدتهم وخالقهم ومصدر وجودهم، كما أن تغيير بعض الأعراف القديمة التي لا تتوافق مع الشرع ومقاصده، ولا تتناسب مع تطورات الحياة يعتبر من أكبر عوامل الإصلاح الصحي والتنموي والاقتصادي في المجتمع، لأنه المسلك الآمن والطريق الصحيح إلى معالجة الواقع وتنمية المجتمع ونهضته وتطوره، لأنه يحقق مقاصد الشرع في مسايرة الأحداث والقدرة على الوفاء بمطالب الحياة المتجددة، وتحقيق مصالح الأمة في كل حال وزمان ورفع الحرج والمشقة عنهم.

This study is concerned with the importance of regulations and legislations in changing customs and customs in many issues of interest to societies in different times and places. It sets the rules and regulations that regulate the movement of society in the context of its interaction with the emerging aspects in the life of modern people to promote society and push the process of development in it. They need people to be disciplined and organized in their various aspects and their health, social, economic and other fields with the rules of Shari'ah, to find the provisions, laws and legislations that regulate and deal with what is new in them, And to inform people of the jurisprudential rulings in the facts and the quotations that are related to their situation and to regulate their affairs and to link them with their faith, their origin and the source of their existence. Also, the change of some old customs that do not conform to the Shari'ah and its purposes, Health, development and economic factors in society, because it is the safe path and the right way to address the reality and development of society and its development and development, because it achieves the purposes of Sharia in keeping with the events and the ability to meet the demands of life and renewing the interests of the nation in any case and time The embarrassment and hardship for them.
