المستخلص: هدفت الدراسة إلى معرفة الاستثناءات الفقهية؛ ماهيتها وأركانها وشروطها وأدواتها وأقسامه، واشتملت خطة هذا البحث على مقدمة، وثلاثة مباحث، وخاتِمة. فأما المقدمة فقد اشتملت على أهمية الموضوع، وأسباب اختياره، وأهدافه، والإضافة العلمية الْمَرجُوة من البحث، ومنهجي فيه، وخطة البحث. وتناول المبحث الأول: تعريف الاستثناء لغة واصطلاحًا. وتناول المبحث الثاني: أدوات الاستثناء. وتناول الْمَبحث الثالث: أقسام الاستثناء. وأبرز ما توصلت إليه الدراسة من نتائج: 1-أن الراجح في تعريف الاستثناء هو (هو إخراج بعض الجملة ب إلا أو ما قام مقامها). 2-أن أركان الاستثناء ثلاثة: المستثنى والمستثنى منه وأداة الاستثناء. 3-أن الراجح بعد دراسة شروط الاستثناء أنها ثلاثة، هي: (القول بوجوب الاتصال مطلقًا بين المستثنى والمستثنى منه، وعدم الاستغراق للقول بعدم صحة استثناء الأكثر، واشتراط أن يكون الْمُستثنَى من جنس الْمُستثنَى منه لصحة الاستثناء). 4-أن أدوات الاستثناء منها الحروف، ومنها الأسماء، ومنها الأفعال، ومنها المختلف في حرفيته أو أسميته أو فعليته، وأن أم باب الاستثناء (إلا)، وهي حرف استثناء فِي الأصل.

The study aimed to find out the Jurisprudential exceptions; what they are, their pillars, conditions, tools and sections. The research plan included an introduction, three subsections, and a conclusion. The introduction included the importance of the subject matter of the study, the reasons selecting thereof, its objectives, the desired scientific addition of the research, the methodology used therein, and the research plan. The first subsection dealt with the definition of the exception in language and convention. The second subsection dealt with the tools of exception. The third subsection dealt with the sections of exception. The main findings of the study are: 1- The outweighing definition of exception is (to exclude a part of the sentence with "except" or its equivalents). 2- The three pillars of the exception are the excepted, the general term, and the exception tool. 3- The outweighing after studying the conditions of the exception that they are three: (the excepted and the general term must be always linked, the exception of the more is not always invalid, and the excepted must be from the species of the general term). 4- Exception tools include prepositions, names, verbs and what is controversial either to be a preposition, noun or verb. The main tool of exception is "except", which is fundamentally a preposition of exception.
