|a الطلاق حق من حقوق الزوج، وطلاقه يقع على زوجته متى كان أهلا لإيقاع الطلاق، ومن الطبيعي أن من يملك حقا يملك الإنابة فيه، ومن ثم فقد ينيب الزوج زوجته في طلاق نفسها؛ فتسمى هذه الإنابة تفويضا، وهو موضوع البحث. والتفويض في الطلاق يقع بكل لفظ يدل عليه، كما قد يكون التفويض مطلقا، وقد يكون مقيدا بزمن معين أو مضافا إلى المستقبل، وحكم الطلاق الواقع بالتفويض قد يكون رجعيا، وقد يكون بائنا، إلى غير ذلك من أحكام التفويض في الطلاق التي يهدف البحث إلى بيانها. ومن أهم النتائج المستنبطة من هذا البحث، أن التفويض هو أن يملك الزوج زوجته حق تطليق نفسها في مجلس التفويض، ما لم ترده الزوجة أو تعرض عنه، لا أن تطلقه زوجته، ويستمر هذا التفويض إلى ما بعد مجلس التفويض، إذا كان التفويض غير مطلق، وهذا التفويض لا يسلب الزوج حقه في الطلاق، بل يستمر هذا الحق معه، وله أن يستعمله متى ما شاء.

|b Divorce is a right of the husband and his divorce falls on his wife whenever he is eligible to divorce, and it is natural that the owner of the right can appoint a deputy. Hence husband may assign his wife to divorce herself, and this deputation which is called authorization is the subject of research. The authority to divorce occurs in every word that indicates it. This authorization may be absolute and may be restricted to a certain time or to the future. The authorized divorce could be retroactive or invalid along with other types of this divorce, which the research aims to explain. One of the most important results derived from this research is that the husband authorizes his wife to divorce herself in the council of deputation, unless the wife refuses this authority, and not to be divorced by his wife. This deputation continues beyond the council of deputation if the deputy is not absolute. However this council does not affect the husband’s right to divorce as he will always have the right to divorce, and he can use it whenever he wishes.
